Please Read Carefully...

  1. Works will be received at Warland Reserve, Victor Harbor between 9.00 am and no later than 5.00 pm. Monday 5th January 2009. If not delivered by hand, consign by courier service, bus, air freight or Australia Post to Victor Harbor Rotary Club, c/- Perks 163 Hindmarsh Road Victor Harbor 5211, so as to arrive before 5.00p.m. Monday 5th January 2009.

  2. Works must be collected at Warland Reserve between 9.00 am. And 1.00 pm. On Sunday 18th January 2009. If they are not collected the works will be stored at your cost and may also be subject to an additional handling fee of $11 including GST. If not eventually collected they will be disposed of in accordance with item 20 of these conditions.

  3. Each competitor may enter a maximum of three original uncopied works. However the Rotary Club of Victor Harbor Inc. May, at its discretion, and by specific invitation, allow the winner of the corporate prize at the previous Art Show, and those Artists who have sold three of their entered works at either of the two preceding Art Shows, to enter additional works. Each work MUST BE available for sale. Pairs (diptych) or trios (triptych) will be accepted as one entry for one entry fee. However the total area of both or all three works must fall within the limits of Item 22 of these Conditions i.e. 1 sq m or 1.5 sq m as the case may be. The works will be hung together and sold as one item for the price quoted on the entry form.

  4. Each work must be the ORIGINAL WORK OF THE COMPETITOR. Original work excludes reproductions or any works worked on by a tutor. Each work must be suitably framed.

  5. Each work submitted must be suitably framed or professionally presented, and submitted with self tapping screws or other flush hangers, substantial hanging wire (not cord). The staple heads on edges of stretched canvasses are to be professionally finished off and covered (tapes or battens). Any works delivered NOT meeting these criteria may not be accepted.

    5a.  The Rotary Club of Victor Harbor will accept no responsibility for damage (shrinkage) resulting from the use of inferior canvas or paint.

  6. Each work must have attached to the back of it a completed "B" section of the entry form the details on which MUST match the entry form "A" submitted.

  7. Each entrant must complete, sign and post section "A" to Box 520, Victor Harbor 5211, with a cheque or money order to cover the cost of entries. Entry fees are: $12.00 for each work submitted, optional larger entry $35.00 (see item 22). THE ENTRY FEE IS NOT REFUNDABLE for any reason Even if the entry is not displayed as per item 10

  8. All works delivered for exhibition MUST be the works as described on the submitted entry form section "A" in regard to Title, Medium, and Price. Substitute works WILL NOT BE ACCEPTED and entry fee will not be refunded.

  9. The judge or judges of the competition will consider all selected works, and shall be such person or persons as are selected and appointed by the Rotary Club. The judge's or judges, decision shall be final.

  10. THE ROTARY CLUB RESERVES THE RIGHT TO EXHIBIT SUCH WORKS AS THE JUDGE OR JUDGES MAY SELECT for a period ending 8.30p.m. Saturday 17th January, 2009 and the Rotary Club shall be entitled to offer any work for sale to the public at the price endorsed on the work and, in the event of a sale being effected, the Rotary Club shall be entitled to retain TWENTY-SEVEN AND ONE HALF PERCENT of such prices as a selling commission (includes GST on sales commission). Any works NOT SELECTED by the judges WILL NOT BE DISPLAYED.

  11. On the announcement of the results of the competition, any work(s) chosen by an acquisitive sponsor will become the property of that sponsor.

  12. ANY work, which is priced to a sale value (including GST) not exceeding the acquisitive sponsors pledge, and has been selected as worthy by the Judge, is eligible for acquisition by that sponsor. (See also Item 14.)

  13. Acquisitive Sponsor these sponsors have pledged a dollar value with which to acquire (up to the value of their pledge) a work of their choice from those selected as worthy by the judge.

  14. Acquired Works any art works entered in the exhibition, (subject to Item 12) having been selected as worthy by the Judge, may be acquired by an acquisitive sponsor. Artists whose works are so selected by a sponsor for acquisition will be given a sponsors "Certificate of Acquisitive Award" acknowledging their success and will receive the donated dollar value of the sponsor for their work. They will also be invited, as a guest, to attend the preview function held prior to the official opening and awards ceremony.

  15. The Rotary Club will exercise all reasonable care in handling the works submitted, but will not be responsible for the loss of, or damage to any works while in the custody of the Rotary Club or the Rotary Club's agents. ARTISTS ARE RESPONSIBLE FOR INSURING THEIR WORKS AGAINST LOSS OR DAMAGE.

  16. The Artist will indemnify the Rotary Club against any cost incurred by the Rotary Club (including legal fees and damages) in any way relating to the work and the exhibition of the work in the Art Show, including claims in defamation and claims for injury and property damage (including damage to or loss of the work itself.)

  17. Works must be delivered free of all charges. No payments whatsoever will be made by the Rotary Club for freight, or other charges incurred in delivery or return if unsold.

  18. The show will comprise such of the works as the judge or judges shall select. Those selected will be on view to the public from 6.45 p.m. to 9.30 p.m. on Friday 9th January, 2009, then daily from 10 a.m. to 8.30 p.m. until the close of the show on Saturday 17th January 2009 at 8.30 p.m.

  19. NOT ACCEPTABLE FOR ENTRY ARE: Non original work (copy or reproduction) any works: inadequately framed, with inadequate means of hanging, damaged on arrival, oversize, collages, pornographic (as so judged by selection panel), 3D, incorrectly priced, not complying with work as per entry form (see Items 8 and 22), beaten copper, batik, poker work, bark arrangements, plaster relief, computer generated graphics, reproductions (e.g. photo-mechanically), photography, ceramics, porcelain, wet paintings.

  20. If a competitor shall fail to remove his or her work or works from the designated address as provided in these conditions, the Rotary Club, after sending by registered post to the competitor at his or her last known address one month's notice of the Rotary Club's intention to sell or otherwise dispose of such works, or, in the event of the address of the competitor being not known to the Rotary Club, then one month after advertising notice of such intention in a newspaper, may sell such work or works and, after deducting from the proceeds the costs of any incidentals to the sale, shall hold any balance for the competitor PROVIDED however that in the event of such work or works being in the opinion of the Rotary Club unsaleable, then the Rotary Club may in lieu of selling the same, destroy or otherwise dispose of it or them in such manner as the Rotary Club deems fit and thereafter the Rotary Club shall be under no liability whatever to the competitor in respect of any work so destroyed or disposed of. Any notice sent by post as aforesaid shall be deemed to have been received by the competitor on the date when it would have been delivered in the ordinary course of post.

  21. Artists by entering work in the exhibition authorise The Rotary Club, at their discretion, to allow any work to be reproduced in newspapers, magazines, the Art Show catalogue, web pages or by television to promote the art exhibition and sales of works.

  22. An artist may enter 1 larger work, up to 1.5 square metres (including frame), provided that the purchase price is $2,000 or more, for an entry fee of $35.00. Otherwise the maximum size is 1 square metre including frame. Oversize works (over 1.5 square metres) will be disqualified and not displayed.

  23. The winner of the open non acquisitive corporate prize will be required to allow the rotary club to have produced a maximum of sixty (60) signed prints of the winning work, and allow the winning work to be displayed on the rotary club's web site.

  24. As the Rotary Club is a selling agent only and at no time does the Rotary Club own the art work sold, the Rotary Club cannot issue a tax invoice to a purchaser on behalf of the artist. If a purchaser requires a tax invoice for the purpose of claiming tax credits, the artist with an ABN and registered for GST will be notified and asked to provided tax invoice for that customer. This invoice must be provided before the sale can be concluded and payment to the artists made. All artists will be responsible for payment of GST to the Australian Tax Office (if applicable) on sales made on their behalf. Please contact your accountant/tax adviser if you require further information as the Rotary Club cannot offer advice on this matter.
