Just sent check to close account with US Bank on a credit card and they hit me with my first late charge with them (I sent payoff checks ahead of due date). This kept the account open and then they hit me with a high finance charge which made me still owe almost $100. They are just adding more to it so it can't be paid off. Total dishonesty to me when I've been a good paying customer. They want free money anyway they can get it. D

I am also a victim of these accessive charges when having a positive balance. During the months of dec 2007& feb 2008, Ideposited plenty of money to cover my tansactions and bills that were payed . Thinking everything was ok I get a overdraft notice. It has charged my account 21 at 37.50 each taking my balance to a neg of $787. After getting staggerd by the news, I transfered money from my savings to put a positive back inmy checking . I called to check my balance it was only $187 available. My girlfiend transfered more money from the savings and all was well untl feb when the same thing occured. This time we deposited enough to cover all bills but deposited in atm late at nite after 12:00 midnite friday. Three days later I checked account balance and it said we were $59.00 dollars. I called the bank on the phone and asked what was up since I just deposited $700.00 - how my account could be only $59.00. The woman I talked to stated to me that the check I deposited was being held for varification. I asked how can this be when it was a payroll check drawn from the same bank ? She told me that when you deposit to a atm at nite on a weekend that the funds would not be credited to account until tuesday, and my account would not be charged . I thought ok fine, no problems. Tuesday comes and I checked balance again. Sure enough $330 in overdraft. Furious I called and asked just what the hhhh was going on this time. After a very loud converstation they would give half of the charges back as a courtsey. I asked why not all of it. She told me they couldn't and that they could charge 10 vs the 6 they got from me. I said some consulation but I still have to pay? She said yes. She told me that they offer over draft protection and if I would like to sign up. I thought ok - maybe some protection would be worth it so I did , and she also stated that it would be 10 days untill I get information. Well, 10 days go by and I get the info -it states I have a 500 dollar overdraft line of credit. Looking at the bottom of this page it states I only have $200 left. I do not know what can be done about this crap but I think this is not something that shouldn't be investigated if not a law suit filed over it. I understand reasonable charges but what is going on here is plain robbery. FS

My dad had his ENTIRE silver coin collection that he inherited from his grandmother stole from the safe deposit box. Who knows how much it was all worth. When he went in to talk to the manager, they called the sheriff and had him "escorted" out of the bank!!!!!!! We can get no cooperation from anyone on this matter, but the amount stolen is in excess of 25,000 dollars. DB

Well, I'll chime in now. I made the mistake of applying for an REI Visa credit card through US Bank several years ago. We're going through a time in this country where everyone's struggling financially. Well, everyone but financial management of major banks. They were sharp enough to fleece the government (which isn't saying much) out of billions of dollars so they could go on like they never screwed up. Well, these banks and financial institutions have just about run out of rope here in this country as the folks that have jobs and a little cash are struggling to keep moving forward while the others who aren't as fortunate have thrown in the towel and let things go. Now these banks have to be creative in robbing the customers that they have left, because this is their last hope. US Bank could be the poster child for banks in panic mode! These guys are a piece of work! I was a few (10) days late on my payment this month and I received a letter today that my credit limit had been reduced from $22,000 to $6,500, which is just above my current balance. Mind you that the last I looked, maybe a year ago, my credit score was a right at 800 (the wife's is 800+). There haven't been any purchases or financial disasters since then, so I assume that I can't be that much of a risk to banks. I've been paying monthly on this account for a little over three years. Sure, I've been late (usuallly no more than a day or two at the most, if late at all) a handful of times, but I also know that banks only report delinquencies to reporting bureaus after the payment is 30 or more days late. When I make this mistake, I am always hit with a $39.00 late fee. There have also been times when my interest rate has spiked upwards of 24.99% for "being late". I have contacted their customer no-service department a couple of times to inquire of their practices and, like I've read here, received a rather cold response. I currently hold a 12.49% rate, but I won't be too surprised if that doesn't spike again. Quite honestly, today's letter is the motivation I need to finally do what I have been wanting to do for a while now. I'll be closing this account and transferring the funds to another account I have that has a 0 balance and will offer me a better rate as well. Although I was spending too much with US Bank in fees, they hadn't made me mad enough to be proactive in severing ties with them. Congratulations US Bank, you finally gave me the push that I needed to make the change. The only advice I can offer is to spend my next payment or so wisely, as it'll be the last of the funds you'll get from me. Yes, I think they're greedy criminals! I'll enjoy a smaller bank much more than this impersonal one. Looks like we might be going back in time folks regarding the businesses that survive and who we choose to do business with. The days of big business aren't as attractive as they once were. Too much corporate incompetence and greed has ruined these companies images and reputations. I'm ready for Mayberry! JC

I am a Vietnam Veteran widow, disabled and cannot work. I only receive a DIC pension. My pension is Direct Deposited is to be available every thirty days of the month and no later than the first of the month, given February of any year, which is an exception. I have received this monetary award for thirty-five (35) years. US Bank will not credit my account until after 3 p.m. on the First of the Month, when the funds are in the account by the 31st or 29th of the month. If I make any purchases before 3 p.m., I am charged an Overdraft Fee. I have nothing to live on this month and cannot purchase my prescriptions, pay rent, buy food or even gas to get to my physicians, etc. I do not have check writing privileges nor do I own paper checks. I only have a Debit ATM Card. To date, US Bank has intercepted and confiscated my March 2008 VA payment, and has assessed my account $583.00 in fees. The total purchases to my account is $1546.90 (two charge I disputed because I did not make the purchase, but US Bank put this "non pin" purchase on my account on 2/1/08 after my deposit then assessing me an overdraft charge of $31.00. They did not apply this credit until February 27, 1008. My total deposits for the month of February 2008: $2803.00. I took two Checking Advances on my account in the amount of $500. The Checking Advances turned into Checking Loans, which US Bank charged me $50.00 for 18 days! The loan repayment was not to be due until March 17, 2008 and March 21, 2008. US Bank removed my funds on March 1, 2008! Each time I would take the advance, US Bank sucked it up with erroneous and continual Overdraft Fees! Purchases (debits) are not credited to account until four days later. When I asked Rochelle, US Bank Specialist about this I was told that it took that long for the "Paperwork" to get to them before they could post to my account. I spoke with Lisa on 2/24/08 and Lisa stated that she would send me the Dispute forms for alleged charges against my account. I never received them. I spoke with Devin on 2/28/08 regarding the forms not arriving and he told me that the merchants had already refunded my money and it was posted to my account. I asked him "which merchants", and he told me all he could see was Walgreen's for $3. The Over Draft charges were not reversed. On March 1, 2008, I went to the ATM and my card was frozen and the message was that I was performing an illegal action. When I called and spoke with Brian and he told me that it was because of the Overdraft Charges on my account is the reason my card was rejected. When I went to US BANK to withdraw my money and close the account, US Bank had taken taken another $550.00 from my account! It doesn't take a rocket scientist to look at my February Statement to see the manipulation and trickery of US Bank in the way they post credit and debits in order to generate more fees! This has left me unable to purchase my heart medications, food, rent, etc. US Bank feels no responsibility to return my money! RG

I have tried for 2 days to make a payment on my card and us bank is the most unfiendly and hardest to access of any that I have experienced. BH

Sick of US Bank...I am disgusted with the services and customer support I have received from US Bank. What can I do to protect myself as a consumer.?. I am already planning on closing my accounts. Looking to make contact with others who have had the same negative results from banking with US Bank. TJM

You're definitely not alone...we've closed everything but had to keep the checking open for our home equity mortgage payments to be automatically withdrawn (stiff penalty we've found if we stop automatics)....but we're looking to refinance anyway...because we don't trust USBank with our mortgage...penalty or no. We do not use our checking for anything but that. We have been ripped off by various and many large fees for small overdrafts and daily fees from the resulting negative balance we couldn't pay off. My wife left in tears one day because we couldn't pay off the 400 in fines from a 40 dollar mistake on our checking....pricipitated by a deceptive online banking page that requires drilling into statements at three levels to find out we really don't have the available balance they say up front....then having the manager of the bank send us on a guilt trip because it was our fault in the first place wasn't it....that guilt trip tactic is perverse...certainly it always starts with a small mistake on our part...but the resulting fines and fees are outrageuos...criminal. wish someone could put together a lawsuit...don't know how to do that...I have documentation though. I had a business card account with USBANK but the business failed and the account turned delinquent.I went into the bank and explained that I had a severe cash flow problem but would shortly be receiving funds from an inheritance. They allowed me to open a personal account even though they said it was against company policy. I deposited a small amount of cash and was maintaining a positive balance. Then I received a letter from USBANK saying that because of my lack of effort to make any payment to the delinquent account they had withdrawn $140 from my personal account and applied it towards a payment on my delinquent business card account. Consequently my account went into a negative balance and I started to receive the usual penalties. I have recently been led to believe that what they did was illegal and a violation of the truth in lending act. Can anyone tell me if this is true, and if so how do I go about reporting it. Another way 5 star sticks ya! Just received my annual renewal notice for safety deposit box. New price is $15.00 for the box. $10.00 for the invoice! What's wrong with this picture. All my accounts are going to be closed. 23 years as a customer at same location, and this is the thank you. Also a victim of the over draft charges on a positive account balance. I won that one. The 5 thieves had to credit me back $127.00! Print screens are a good tool to have in court if needed to go that far! C

After receiving $175.00 in overdraft charges last week, I wrote to US Bank to ask them to consider helping us to reduce some of these fees. I am from Canada, and I have used debit cards extensively in my 41 years. Never in my life have I ever seen a bank that would allow charges to be made, knowing that there weren’t sufficient funds in our account. We were off by about $2.00 and they just kept letting things be charged instead of declining. I could almost hear them rubbing their hands in glee and cackling about the stupidity of people that live from paycheck to paycheck. After I wrote to them, I got this reply:

I have reviewed the account and have determined that the fees you have been assessed are not due to a bank error. Since these are valid fees, we can not credit them back to your account. Please let us know if there is anything else that we can assist you with.

This is my reply to that email: Thank you for clarifying US Banks stand on Customer Service. My husband and I have decided to switch all of our deposits to a Credit Union as they are more interested in Customer Service than in the almighty dollar and who is right and who is wrong. My husband and I have banked with US Bank a long time and we recently went through some very stressful times with his layoff and my immigration fees (I am Canadian). To have our bank rob us of an unnecessary $175.00 was the last straw. You might want to rethink your policy to include room for at least one mistake a year, as our new bank does. We acknowledged a mistake made by US Bank in the past. After asking them not to charge us for our checks to be returned us, knowing that we ordered checks with a duplicate, $5.00 per month was still charged to us. We didn't make a big stink about that one, but this one has us fuming. With a little research, I realized that we aren’t the only unsatisfied Customer of US Bank, just one of hundreds. http://groups.msn.com/USBankComplaints/links.msnw Looks like we are joining a large group of people. Given that we both work for some of the largest businesses in our city, I'm sure we will hear more complaints about US Bank.
After this fiasco, I called my local Branch and left a message for the Branch Manager to please call me. I never did get a reply to that. Today, over a few dollars, we went into overdraft again. Charges that were made last week, finally went through. Today, we were assessed $105.00 dollars more for overdraft fees. For a country that is in recession, I am amazed that a bank is willing and able to assess these fees and hurt the blue collar workers. I think it is awful that my husband and I are working two jobs, trying to get caught up and still have a hard time making ends meet. Yes, I could have had overdraft protection. Being fairly new to the US has me learning to adapt. I have never wanted to go back to Canada as much as I did today. We spent a lot of money on immigration and I have worked since the day I got my green card. I think it’s a travesty that unsavory and shady capitalist corporate bloodsuckers are making money off the naïveté and bad fortune of its patrons.My Husband and I will be in Thursday afternoon to close our account. We will beg and borrow to pay off the almost $300.00 in overdraft fees that we have paid over the past few days. All to make sure that our account is closed and we are done with US Bank. We will also be sending this letter out after that, to every news agency, government entity and Bank that we can. We truly hope that this doesn’t happen to any other family that lives from day to day, hoping to make it through a very lean time in life. SV

When I sighned up for service at the bank they had there 5.00 rule.They have since dropped it because they were losing to much money.The agreement and policy I sighned on for they changrd.I wonder if I could make them prove that I sighned an agreement to allow for od charges,if they couldnt wouldnt I be entitled to a refund of past od charges?I believe I might have to send a letter from an attorney demanding all info (discovery) but after that small claims court is free to us.PEOPLE,WHEN ENOUGH OF US TAKE ACTION INSTEAD OF JUST COMPLAINING THATS WHEN THINGS CHANGE. In 2000 we were having finacial problems so we hade to give our car back to First Star Bank. We filed bankcruptcy on the car. Then in 2003 we were selling our home, (my mother had got a personal loan from US Bank out to help us refinace the home). So when we were selling the home we asked the title company to see if we still owed on this 2nd mortgage from my mother. At that time we didn't realize that it was just a personal loan she took out so we had no 2nd mortgage. So when the title company sent them a letter asking what the pay off is for the 2nd mortgage, US Bank sent the title company back a letter saying here is your pay off per your request in the amount of $6400 owed with an account #. The title company put it on our paper work that this was a mortgage being paid off. They did not know it was really a car loan. They said they would not have paid it because it's our responsibility to pay personal loans. US Bank did not put anywhere on the paper that this was a car loan. We did not owe on this car it was voluntarily repossessed and listed on bankruptcy. On our credit report this car loan was from First Star bank and I guess US Bank bought them out. We did not know this. That is why we did know that it was not a 2nd mortgage. So US Bank knew thay were trying to get money that was not for them to get. I hope this ia not happening to other people. It's not right. MC

I have been studying this message board for the past 10 hours reading all of the injustices done to US Bank customers, only because I started being a victim of these Deceptive Banking Practices as of approximately a week and a half ago, after being a faithful customer of US Bank for over 12 years. I was treated like a Queen when I had steady automatic deposits of over $1,400 every two weeks when I worked for a large company and received a steady paycheck. I was laid off of my job after 21 years of service in 2003, and the only job I could find was a sales job on commission only (when you are approaching 50 and worked for this company for that many years, prospective employers think you were Under Worked and Over Paid). My salary for the past 4 years has been way below the poverty level, but thanks to my boyfriend's steady paycheck, we have managed to stay afloat with the mortgage. Needless to say, my deposits have been meager, at best, and my credit has gone from perfect to very poor. Ok. This is the last straw! I just noticed a few minutes ago (4:00 PM PST on January 29th, 2008) that US Bank just charged my account for 2 OD's of $35 each, when my AVAILABLE BALANCE was $229 and change this morning. I signed up for the Email Alerts after my first fiasco with them over a 54 cent error I had made in my register, and received an alert THIS MORNING at 6:30 am stating my account was -$134 as of 1/28/08, which was yesterday. So, I called up CS at the 800 number and asked what was going on. They told me that the $556 CASH deposit I made at my Albertson's branch ATM machine on Saturday, 1/26/08, didn't post until the next business day, which in their opinion was this morning, 1/29/08, and on Monday, 1/28/08, my mortgage was taken out through EFT and a $4.75 charge to the WSLCB; therefore, since only $100 of my $556 deposit was available immediately upon the deposit, my AVAILABLE Balance on 1/28/08 was not sufficient to cover those 2 transactions; hence, the 2 OD charges TODAY. My Albertson's US Bank branch is open 7 days per week, so every day is a business day, according to my way of thinking. Even if that is wrong, the next business day would be Monday, 1/28/08. My deposit receipt is dated 1/26/08 with a Posting Date of 1/28/08; however, they told me at the 800 number that the next business day is the day after it posts, not the next business day after the deposit. If I would have known that, I could have gone to the bank in person on Sunday or Monday and made the CASH deposit then and I wouldn't be going through this grief right now. I new my funds had to be there on Monday to satisfy my mortgage payment. I DID NOTHING WRONG this time. No 54 cent error. I made my deposit in good faith at their ATM in CASH, not a check that needed to clear, but in CASH 3 days ago. They do nothing but lecture you about keeping accurate records in your register. Well, if that's the case, I made a deposit on 1/26/08 of $556 (added to register on 1/26/08), a direct deposit was added for $173 on 1/28/08 (added to register on 1/28/08), my mortgage of $1,030 was taken out on 1/28/08 (subtracted from register on 1/28/08) and my $4.75 for a pint of vodka was taken out on 1/28/08 (subtracted from register on 1/28/08), making for a grand total of $229 balance on 1/28/08. A week and a half ago, I didn't realize that I had made a 54 cent error in my register until 4 days later, when I received the OD note card in the mail. The day I was overdrawn by 54 cents they charged me $31 (which I didn't know about), so the next 5 or 6 online purchases I had made (all transactions UNDER $10) got charged $35 for each, making a grand total of over $206 in OD fees. I did get the CS lady to reverse 2 of the 6 charges after listening to this kid lecture me on keeping better records. I sure hope she never makes a human mistake in her register of 54 cents and has to pay the price. I did report the injustice to the Attorney General's office after the 54 cent error and they sent me an email saying they would look into it. NOW THIS...and you can bet, after I'm done writing this post, it's getting cut and pasted in a Complaint Form on their website. If we all get our injustices to the right audience, they should sit up and take notice and investigate this bank's Deceptive Bank Practices...What better Attorney could we get to represent us then the AGO...PLEASE report your stories on their Complaint Form on their website. This has got to stop and US Bank needs to be held accountable. Not Happy in WA

Why don't we all band togehter and file a class action lawsuit against these crooks. We have a mortgage with these crooks. We have had payments credited to accounts that are not ours. They held two payments and we did not know about it until a letter from our bank telling us they did not accept the payments until two months later, We had an agreement with them to make a payment and 1/3 for three months to catch up on our mortgage, by doing this it put us behind 4 months. We could not find the third payment. When we received our 1098 this week there is an overage in our escrow for a payment and 1/3. We ended up filing bankruptcy last May when all of this happen, because we did not want to lose our home. On Nov 10, 2007 our home was destroyed by fire, USBANK said we had to give them the insurance proceeds for the pay off and to quote them " We think it is best if you look elsewhere to finance a new home" But score one for us little people. Our bankruptcy attorney filed a motion with the court asking that we be awarded the insurance settlement and build a new home and that we continue our loan as is. The judge ruled in our favor. We then were locked out of our account with USBANK online. They sent a payoff statement which is for 10,000 more than we originaly borrowed. We have been making payments for seven years. How to we owe $10,000 more. The interest on our 1098 is short $3,000, the amorization schedule does not match. If we band together, we can stop them, 100 voices are louder than 1 voice. I am in South GA near Savannah. Anybody want to kick some US BANK BUTT? We can do it together. K

I just received a phone call from a lawyers office regarding a lawsuit US Bank has filed against me... for an account that has been closed for almost 3 years... that was overdrafted to negative, on an account that wasn't being used... then, closed and sent to collections (apparently) that I never received any further information on. At close, my account was negative $40.oo? But, according to the man I just talked to, it's at $568.22, now. How does that work? On top of lawyers fees and all the other bullshit that I can't pay for anyway... I've never been sued before... isn't there a statute of limitations for things like this? I don't even know where to begin with this. I'm still taking in the fact that they may garnish my wages 25% and drop my FICA score 100 points because they couldn't get their heads out of their asses... :( J.S.

This is not a major horror story but nonetheless I was ripped off. us bank seems to like charging overdraft fees when there is money in the bank. And believe me, I called after every transaction. I know it sounds like a hassle but after situations like this it is well worth going thru the hassle. It seems that they like to do it every couple of months. I was just told (which is a lie) that it is impossible to call and get an accurate balance. After calling after every transaction you know if it gets automatically deducted or not,which it does, unless you use debit. Then sometimes it takes a few days depending on where you made the purchase. I was also told that they allow this for reason. They let you make purchases that you can't cover (which I did have money to cover) and then charge you an overdraft fee for it. They call this emergency money. If you really need it, it will let you go over (which I did not do). When you talk to several people about this,you will get several different answers and I really dont think that making a purchase at mcdonalds for 1.09 should be considered an emergency. Apparently by doing very little research, I found out that us bank has stolen money from customers for years. What I would like to know is why are they still in business? We need to work on shutting banks down forever that operate in this manner. G

I had enough with the US Bank, very poor service in the Twin Cities branches, employees like molasses in winter...sitting on their asses powdering their faces. Customer, lined up, they don't give a hoot. I do have a substantial amount of dinero floating through the bank, but guess what, no more. Checking out the competition, where there is no age discrimination, a little service with a smile, and a little respect. I opened a US bank account a few months ago for Christmas /New Year's spending. After spending money, on a few items only I'm $140.00 in overdraft charges when I should have had a positive balance. Started out $434.00, one of transaction held $423.00 even though I signed for a straight transaction of $339.00.Without my knowledge, it kept a extra $84.75 for services(just in case). I made 2 more purchases thinking I had the money. "Boom" two overcharge draft for $31.00 each. They then released the money charging me a overdraft charge for the initial transaction which put me into being overdrafted because took their $62.00. Leaving $303.00 to pay the $339.00 charge plus one other transaction. Now, I'm $112.00 in the hole. I received a notice in mail about the overdrafts and took tell me that there would be a $7.00 per day "negative balance" charge assessed my account. When I checked my account this morning they had already put the charge on my account. Bringing my total of overdraft fees to $140.00. If course when tried to explain and get the charged removed, they said they couldn't help me. Take it up with merchant, it's not their problem not their fault. The merchant doesn't know why there was extra money taken out but they investigate. I had to "stop the bleeding" so I put money in the account to stop the charges till the vendor and the bank can work something out. Needless, to say I must close this account before they find a way to own my home. BB

NOTHING THAT US BANK DOES WOULD SURPRISE ME. THEY ARE CROOKED AS THE YELLOW BRICK ROAD AND THINK THEY ARE ABOVE THE LAW. This posting is to describe an experience with US Bank and its apparently regular practice of allowing the fraudulent deposit of checks through its Automated Teller Machines (ATMs). I am extremely interested in learning how many others in the country have had a similar experience. In this situation, US Bank repeatedly accepted - through its ATM system - fraudulent deposits of stolen checks on which the name of the payee and endorser clearly did not match. Despite this mismatch of payee and endorser, US Bank continued to accept and process these deposits for a significant period of time. Furthermore, at no time did the bank ever notify the payee of the checks that these illegal transactions were occurring. To date, US Bank has refused to take full responsibility for its actions and to make things right. If you or someone you know has had the same or a similar experience with US Bank, I would sincerely appreciate hearing from you. Given the ease with which the thief used US Bank ATMs to make these fraudulent depositis, I suspect that others have been victimized in the same manner. LM

Everytime I have deposited money into the bank (cash) my money does not get posted to my account. they tell me there is nothing they can do blah blah blah I am disabled and can not drive to the bank and every time I go the the Issaqhah WA bank they screw up my deposit. SC

I recently opened a checking account with US Bank in Juanita, WA. During the process I asked the normal questions like; Is there a charge for Money Orders, Is there a charge for money transfers between accounts, is my money available immediately after deposit of local checks. The answers to all these questions were all positive, no charge for money orders, fund transfer within bank accounts, all deposited monies available immediately except out of state chaeck. All sounded great. After that everythng changed, they hold all checks over $1000.00 for 24 hours, including checks written on local banks. They limit how much you can spend online within the first 90 days with your ATM/Debit card to $1000.00 regardles of how much money is available in your account. Banks use our money to earn interest for the bank. During the hold time they are making money and not sharing that with us. USBANK says that even if the error is on their part for not giving you all the correct information that it's not their problem. They tell you that during the first 90 days you can only charge a max of $1000.00 for online shopping but you can charge up to your balance at the local store using the same Debit card. Can you see a problem with this picture. This was the attitude of the Customer Service Manager at the Juaninita, WA Branch who's name is Misty. I got some help from Dave the mnanager who made a call and was instructed how to increase the limit. Even after all of that it may take 24 to 48 hours for the increase to take effect and could still cost me $600.00 for the year because if my son can't pay for tuition before the classes are full he would not be considered full time. I just received a total of $500 in overdraft charges this last weekend because US Bank holds any deposits for a business day. I deposited $1900! I talked to the bank, they were willing to refund $100, I guess that's better than nothing-but does that seem fair to anyone? Most of the charges I overdrafted were for .95 cent sodas, or $3 cigarettes. How is it illegal for blockbuster to charge their customers more in late fees than the total worth of the DVD, but it is okay for banks to do this? I need a new bank. L

How can US Bank tell you that you have a checking account balance and an available balance? Then, your available balance is in the negative but your account balance is positive they overdraw your account. The explanation is that you had other charges. Well, I was still in the positive. The solution: I should call each day to see what my available balance is or look it up on the internet. How can they get away with stuff like this? SC

We use are Debit card for small amounts, which takes out of our account balance. But some how we end up with NSF and they have fixed 2 times in the last 2 years because they took them out twice causing a large amount of NSF. This is happening again and they refuse to fix it saying they have fixed it once in 11 months. This is not lawful and this is money we have earned. They have no explanation except that I need to watch my spending. When I called the customer service they told me it is the Manager of the banks decision and they have to go with that and they told me there was no one else to speak to. Each NSF causes me to loose 35.00 for each one adding up to this past month of 700.00 dollars. They said that the cedit card amounts are not taken out 'til the next business day but have no explanation as to why, when you make the purchase it goes against your amount immediately. US Bank sucking money from my account - I too am a victim of a positive account and all of a sudden the bank takes a fee for a negative balance and then another fee for being overdrawn. I have called an complained only to deaf ears. Why cant someone start a group and file a class A lawsuit against US Bank for the practice of seizing funds like this . Yesterday, 10/5/07 I had to go to US bank to clear up another matter among many. Since I have been banking with US Bank for about 3-4 four years they have taken over $1500.00 in overdraft fees which should not have occurred based on the what they told me to get my business. US Bank are liars and each bank does business differently. My friends often talk about their injustices. When I first opened my account I made it clear to the personal banker how my business (Contractor) works and I made it clear I buy supplies daily . But when my client checks start hitting my accounts ...US Bank starts holding them over for weeks at a time...even government checks, and money orders until they post as insufficient funds. They charged my accounts 34.00 fees each transaction and then $7.00 dollars a day until I paid them off. In my first two weeks I paid USBank a 3rd of my profits from my jobs. Time after time I do not understand their posting system after many confrontations with them. Except I was robbed blind on every turn. They even started charging my employees $10.00 fees to cash their check at the bank. I have got charged over drafts fees for a small 24 cents. I got charged $34.00 and the charges I have gotten were common errors most banks do not concern themselves about. ALL /MOST of my so-called overdrafts were under a dollar. In accordance to the online information I have a positive balance but some how I end up negative? And they have nasty attitudes telling me I am suppose to keep a register and not rely on the online statements. A bank manager who works at the Ladur Bank in Clayton Missouri deserves to get slapped!!! if I ever see her. She was rude, nasty and indirectly called me stupid because I could not understand their system and it doesn't make sense. After speaking with her I closed my accounts out totally. All I know the negatives never appear in the open until you have been charged an overdraft. They cancelled one overdraft and refused to cancel the other which caused the overdraft in the first place. On 10/5/07 I asked the banking manager shouldn't she remove both since it was a domino affect? She said "NO! You going to pay for one of them!" If I was in her face...I bet she would have gotten sarcastic with me. I tried to call her regional manager twice that day...but I guess he was on the golf course. J.A.

They have pedatory policies that kill you when you make the least mistake (or when they make a mistake)....but the thing that irks me as well is if its your mistake is its your fault...guilt guiilt guilt...true I may have made the one mistake but they use that guilt to keep you from seeing the peadatory practices for what they are... OH! and don't be fooled by the overdraft protection offer...If you use it there are still fees two new types of fees and being in only $25 increments its possible to still get multiple overdrafts in one day...they still charge the biggest one first. High interest and the fact thay you have to take out a credit card are kickers as well. They'll use the overdraft protection as a tool of guilt as well. Finally one other guilt option is the "you should look at the website for your current activity" .... yeah right!...not everyday and there is a serious deception on their on-line banking about the funds available...the first screen gives an incorrect funds available total...then the detail also gives an incorrect funds available..you have to drill thru an unlabeld link to finally see where you are at on any given transaction. We only keep our account open now to pay a second mortgage monthly until we can refinance .... PREDATORY...INTENTIONAL...and they train their people to do it support it.JH

If you send any creditor a "Cease and Desist" letter, preferably by registered mail so they can't say they didn't get it, by law, they HAVE to stop calling you. As in, "You must immediately cease and desist calling me at any phone number you have on record." (Google "cease and desist sample letter" and you will get an idea of what to write. You don't need to write much.) You have every right to deal with any creditor only in writing, which is a wise thing to do anyway...then you have a record of any arrangements you make with them, and a written record if they bully you. If they disregard your cease and desist letter and call you anyway, tape them on your answering machine or a tape recorder. If they leave you a nasty voice mail, all the better..they can't say they didn't know they were being taped. If they call you after they receive your letter you can collect damages. Personally, I intend to file a complaint about USB with my state Attorney General's fraud division AND with the Better Business Bureau, but from what I have read from the members of this list and all the complaints that show up when one "Googles" US Bank, if one of our more well-to-do members were to file a class action suit, there isn't anyone here who wouldn't join the suit as a co-signer! This week I will be switching to a credit union, something I should have done the FIRST time they screwed me out of several hundred dollars of overdraft charges and fees for their own errors, which they refuse to own up to. Recently, on their web page and in the media, they had been touting their low balance alert as "immediate." To any consumer and any dictionary, "immediate" means right away, instantly, etc. To USB, "immediate" means "after we close the books for the day and already charge you an overdraft fee." The patronizing young manager claimed not to know that their website said "immediate" and indeed, the web page has since been changed. Too late..I took screen shots, and I intend to use them. Don't you just love how they patronize you about your banking responsibilities, as if it were THEIR money in our accounts, not ours. DON'T DEAL WITH THIS BANK EVER! We had no idea when we leased a Mercedes thru them that they would be stalkers! There is no grace period, period! My husband travels and only pays bills once a month. Their cycle is like 20 days! They call us from 8am till 9pm , including weekends. (Love those late night Sunday creditor calls.) For being 5 days late!! Citibank doesn't do that. Their "potential overdraft" charges are exactly why I closed my account a couple of years ago. After unsuccessfully trying to negotiate a resolution, I ended up filing a complaint with the BBB. US Bank was adamant about these potential overdraft charges being part of their policy and stated they had notified me via mail (through one of those fine print privacy-policy-like booklets you get every now and then). I can't believe they continue to get away with ripping people off like this. F

Exactly...they are predatory. Certainly we make some type of imbalance mistake at the beginning...and thats the hook they hang us on. Fees Fees Fees...once you're over they stick you...they're policies are awful and they are varied in the ways they get you on your checking....overdraft protection..we got it ....still fees but they call them different names...still they pile on and add up....we figured our nightmare (caused by being over maybe 40 dollars because of an accounting mistake leading to 500 in fees over three days) would have only had 100 less in fees if we had overdaraft protection... KEY point: Don't let them put the guilt trip on you! Thats a key tactic...because it always starts with a small mistake on our part. Sure we made that mistake but the pounce with their fees and policies and you may never get out. Call you congressman. That is key....he might be bought off by USBank but enough noise and maybe something will happen. My life is ruined thanks to US Bank, at 11 pm one evening i bought some burgers totaling 10.36 at white castle, i had 9.90 in my account, the next morning i cashed my check and put 300 CASH into the account at 9am when they opened because they hold paychecks for no reason and at the time i got free cashing through my employer, well i got charged a 31 dollar "potential" overdraft, i went in and raised hell, they said there was nothing they could do, thats how the policy was, even though they changed the policy after I opened my account there, well after all my bills where paid i was left with again, 9.90 in my account for two weeks, but I had cash so i just left my bank card at home, well I go to deposit some cash two weeks later and low and behold! I'm negative 90 dollars! because my Instant check card took 10 days to process, and because my actual balance was not able to cover it, I got hit with a Second overdraft for the same item and all the daily fees that come with not paying attention to an account I was not using at the time, I went into the bank again and explained that they had charged me double for the same item, and they said it was my fault for not managing my money, Fine I offered to pay the OVERAGE not the fee associated with it cause it was twice for the same item, I even offered to pay the daily fees just not the overdraft fee, no can do, they had reversed a charge for me 9 months prior and would not do it again, the branch manager told me the same thing, I left, I had forgotten about my movie club at the local rental place (which I also wasn't using) which does automatic 15 dollar payments every month, they let that process for 4 months, with all the associated fees WITHOUT even notifying me! I never heard anything from them, here I sit, 10 months after I left that branch office frustrated and I cant open an account ANYWHERE because 6 months ago they charged it off to chexsystems for the amount of 958 dollars! They didn't notify me of any of this! I talked to the agent for a while at the credit union I was applying at and she informed me that in Minnesota you can not BY LAW open an account for 1 year after a charge off and that NO BANK would open an account EVER for me until that balance was paid, this is not a agent of USbank this is a competent agent and a competitor! Both Chexsystems and USbank are CORRUPT and ABUSIVE, with my income and living expenses I'm left with 50 bucks a month "fun money" am I supposed to give this to some greedy bastards for the next 2 years if I can EVER hope to own a home one day! Since when does it matter who makes a deposit into an acct???I tried to make a deposit into my husband's business acct with a comcheck(similar to a money order) & the teller said i couldn't because the check had my name on it.My husband is a truck driver & was away at the time so I had to do it.I just don't understand what difference it makes where the $$ is coming from when making a deposit.i can see if it was a withdrawal then there might be a problem.Joe Blow should be able to come to the bank & make a deposit if he wanted to.Maybe he might want to suprise someone by making a deposit.A comcheck is basically a money order so already paid for.So anyway i had to go deposit the check in our credit union then write a check to my husband(he signed it the next day btw)& deposit it into his business acct.today.I spoke with the branch manager of USBank & told her this whole journey of inconvenience is one of the reasons there are so many posts & blogs about USUCK Bank.Five star service my ass.We have had sooooo many problems & that is why we no longer bank there except for my husbands business acct(he also has one with our credit union).I HATE USUCK BANK. I just got a letter from USBancorp corporate office telling me that it was my fault that their inept employees and poor customer service and that they did me a favor by only stealing about $170 bucks from me. I moved to Cincinnati from Ft. Lauderdale about 2 months ago & have already been screwed by US Bank. Funds appeared in my account online only to be withheld. Hence several overdraft charges. So they stole money & are accumulating daily charges for sitting on their midwestern greedy arses. Does anyone know of any class action suits or legal battles against this embezzlement??? AMEN....we've been ripped off too...get out of there as soon as possible. We've gone to Marine Bank but almost anyone else is better than US "predator" BANK. Watch out for overdraft charges if you live close to your limit. Credit line backup of checking is also a scam...no protection ...fess also, just a bit less. DONT get credit with USbank....we have a heloc that forces us to keep the checking open for direct withdrawal...if we close...fees. When rates are down a bit, we'll refinace that and be rid of the tyrants forever. I have a checking account and a savings account through US Bank. We turned our saving account into an account for overdraft protection. We assumed that it meant if we needed money we could withdraw our own money when ever we needed it. We have had to transfer money from it 15 times in the last two to three months and were sent a letter yesterday that we have gone over our accounts limits of withdrawing our money to our checking that each time we went over our six withdrawls they took ten dollars totaling $90. We where charged several overdraft fees because the bank holds your money making it look like you have nothing in your account. For example we had several charges over a weekend. I balanced my book it said we had 380.00 in the account. There was a few weekend charges for bills i paid total=290.00. Well we spent 3.79 here and 2.46 there and ate out 47.87 and they assessed us 93.00 in overdraft fees!! Another day we had a balance one day of 386 and got slammed with over 100.00 in overdraft fees. They make it look like they are charging your account 2 time but they don't actually do that in the end. They HOLD the money over here, and charged it here 1 time but it makes your account look negative Since its on hold and deducted when they charge you. So they can assess a FEE. I contacted the bank in Denver and they told me they would not take the fees off it was my fault. They further told me perhaps i need to learn how to balance my checkbook. I was actually screamed at and the associate told me the system was simple and i just did not get it. I have NEVER OVER-DRAFTED AN ACCOUNT IN MY LIFE (until i came to this bank)! The next day i had a direct deposit post my account was positive 2015.00 and i got another overdraft fee for something on that day even though my account was positive. 1,000 on top of my deposit. They just rip you off for overdraft fees. I still have my account online...this is hard to explain how they do this so my plans are to make a video of my account online to submit in a lawsuit. Who knows maybe one day someone will blow this out of the water and its going to be bigger then Enron. Someone at this bank is really doing something bad i hope the FEDS investigate this bank. Paper trails they cover good. but if they are smart the will open an account to track. My hope is others read this and don't bank with them and get ripped off like i did. I opened my checking account in 1994 at the time I think it was still Hawkeye Bank. The woman there told me that it was free checking, no monthly membership fees or anything like that. In the ten years after that it switched to Mercantile and then Firstar. With both of them, I had no membership fees at all. Suddenly it switches to US Bank and now I have membership fees and it was that way for about four or five years now. I put up with it because I figured that it'd be too much trouble to switch banks. Last year, I got paid the Friday before Labor Day and deposited the check the next day. I spent about $20 that weekend at a movie theater. On Wednesday night I went to the grocery store and stocked up on about $150 worth of food. I knew that I had about $2000 in my account. I tried to use my account and the machine rejected my check card. I then reluctantly used my credit card to pay for it. I went to a coffee shop and checked out my account on my laptop. Turns out all $2000 was in there but they were holding all but $125. This is just insane. Holding checks for almost a week after depositing them is crazy. Even more crazy by the fact that the check I deposited on Saturday was from a US Bank checking account. Freaking stupid. But for me the "screw US Bank" moment came last week. I had surgery earlier this year and was recovering until about mid April. Finally got back to work and I got about 1/2 of what I normally get for April. So I had to be a bit careful with how I spent money this past month. Well that didn't go so well. I thought last Monday I would have at least $10 left when the month ended. Turns out I forgot to write down a $10.10 check I wrote. So I was 10 cents overdrawn. You'd think that if the overdraft is less than $1 they would let you know so that you could fix it. Instead, their solution was to charge me a $31 overdraft fee and send me a piece of mail which I got a few days later. Luckily I noticed it on my online account and took money from my savings account and switched it to my checking account before they could steal more in the form of "fees". But I had it with them. Charging 310 times the amount of the overdraft is ridiculous. After my last automatic withdrawal in a few days, I'm going to shut down my checking account once and for all. I found a Credit Union that is much, much better. No overdraft fees (if there's enough money in your savings to cover the overdraft) and no membership fees. Probably twenty years ago, most of my extended family were members of the bank. However after four acquisitions in less than 10 years it's now just a corporate bank with a few local branches. I'd say that my sister and my parents are the only ones still there; and my sister is leaving as soon as she gets finished with college and settles down somewhere. M

US Bank has charged me two NSF fees, not based on what my actual balance is, but rather my projected balance. Of course their online banking does not clarify what drafts they are actually charging you NSF fees. Upon emailing them I receive tips on how to balance my account along with a suggestion to use their email or text alerts. A lot of good an alert does when it doesn't alert you until a minimum of 24 hours later. This is ridiculous, are the utility companies going to start charging me fees based on the possibility that I might be late in the future?! I absolutely will stop doing business with US Bank and will go back to doing business with a Credit Union. I also fully intend on complaining to the Federal Reserve Commission.... along with posting on every message board I can find. I may have no other recourse, but I do have a choice not to do business with a bank that uses unfair practices to profit off of its patrons! TR

My account was in the negative by 83 cents and they charged me 26$ dollars on 83 cents. They told me that I would have to get a credit check for overdraft protection. But 83 cents come on. TW

They Froze my account the day after I asked how to close it - I made a few deposits in 2 separate accounts on Friday, May 11. At that time, I requested information on how to go about closing the joint account. I also requested information on how to close my personal account just to be sure I was clear on their procedures. I told the teller I intended to close them after my final automatic payments went through on today, Tuesday, May 15, 2007. I looked online at my account today to be sure all was good and noticed my account listed my account balance as $1295.86. But my available balance was -$40.02! I called the bank and they said that the fraud department had flagged those PAYCHECKS, the SAME PAYCHECKS that I deposit every week into these accounts and WOULD BE HELD until May 22! Not only that, I "will incur overdraft fees on the purchases and checks already made/written because the money is not available." They are totally and completely screwing me! I have had numerous overdraft fees when I clearly have positive amount in my account. I then get "negative balance" fees…and THEN they add fees to those fees! They have CONSTANTLY and CONSISTANTLY screwed me over and over. I thought perhaps I was a bad banker and that maybe I *have* miscalculated my accounts. But the more I talk to people and the more I read up on the consumer complaints, I realize I am not the only with these problems. And now that I want to close the accounts, I CAN'T! It is an unbelievable and unprofessional institution who is out for the almighty buck and has no regard what-so-ever for their customers and employees! JM

Overdraft fees - available vs account balances....ok so even if I buy that...they apply items for a given day largest to smallest so multiple fees occur on minor charges... Well I guess it's time for my 2cents in airing my complaint. I was happy that I was able to open an account with a Bank and ran 75k or more through that Bank within the last 2 years. Being busy and trying to keep my business alive I had no idea these folks were ripping me off slowly. Anyhow, I went to deposit my pay roll check and discovered that my account was overdrawn to the tune of $335.00 and I was flapper gasted. "What how could that be I asked?" the teller pulled off a statement and shown me 9 overdraft charges. one was for .75 cents and the other was for .12 cents. I contacted a customer rep (Denise at the 1800 US bank #) and what a smooth talker this lady was. She was polite and kept apologizing, but she could not reverse any charges and kept insisting that I had over spent my account and my creditor's were paid. She recommended that I contact a person at my Branch and try to correct the problem, I was in the Bank for about an hour I talked to a CS representative by the name of Charise who indicated that the maximum amount she could authorize to deduct was $91.00 as a result I did not deposit my check. As a result I was in a financial bind till Monday. As a result my account will be negative and a $7.00 charge per day will be assessed to my acount. Any advise on how to fix this problem would be greatly appreciated.CR

How USBank can ruin a life - I have been a US Bank (Firstar) customer for almost 10 years and never really had a complaint until last Sunday. As I was downloading my transaction into Quicken there was a tranaction for $1,150 for a computer. We have not purchased a computer. I immemdiately called the 1-800 number was advised to destroy my Visa/Debit card (which I did) and I was forwarded to the Bank Fraud Department. We went through all the transaction presented to the bank and low and behold there were other othercharges totally approximately $70. I was assured this would be dealt with promptly and within 7-10 working days a provisional credit would given to my account. On Thursday (4 days later) I called the Bank Fraud Dept. again and low and behold -- my case at not even reached a Fraud specialist -- and you ask why -- it was several floors up and their interoffice mail takes at least 2 days (doesn't the pony express work faster?) This is when I lost my temper. I cam currently $-1,900+ overdrawn -- when I started out on Sunday I was $200 to the good. And you ask why???? It's all the NSF charges because my regularly scheduled payments (to the electric, phone, etc) have been going through -- well, at least they're not bouncing the checks. The kicker is -- I was told that all of our electronic deposits would cover the overdraft?????? So, in other words, I don't have money for the mortgage and insurance which are due on the 1st. I've been without my insulin and heart meds now for 3 days. Can't refill the perscriptions because I don't have MY money. And guess what the US Bank Fraud dept told me about that. See if I could borrow money from a friend. Right! We have notified our employers and cancelled the direct deposits so we will get hard checks and will open a new account -- by that isn't until the 6th. Have any ideas how to get this bank off its rear end and get going? P.

usbank protects itself instead of its customer - I made a large deposit with usbank. usbank put a hold on funds releasing only a portion 5 days after deposit. The remainder won't be available for another 5 days after that. The deposit was made with a IRA account check. usbank claims its for the customers protection. Bull Hocky! No other bank takes this long or treats their customers this way. After 30 years of doing business with this bank I think its time for me to change banks. If more people would do so usbank would be sent a message that they need to stop their tactics or go out of business. JF

In a nutshell, I had $22 in my account on 2/16/2007. On 2/20, I deposited $3209.84. Right after that, I have a $35 Returned Check Fee??????????? There were 5 electronic transactions that day and none of them were delayed or charged The only check presented that day was a $347 for my car payment!VM

Today as I was waiting in line at the bank of Satan. I noticed that at least half of the twenty or so people were having account issues. Whether it be overdrafts, funds that were not available to them because of holds or my personal- an involuntarily cancelled bank card. I do not exaggerate when I say 50% of the people. It is an unmistakeable gesture when some one starts shaking their head back and forth at the teller. When I got closer I could hear what most of them were saying (described above). After my baby is born I will be at home a little while and on the phone to lawyers trying to figure out how we can stick it to these a-holes. I don't care how many freckle-punching contracts these jerks can pull out their arse.... there's always a loop hole. There also appears to be no shortage of disgruntled US Bank custmers either. US Bank ripped us off, too! Me and my hubby, Frank had U.S. Bank do this to us: Frank had $1,001.00 in our account, which was balance on Jan. 8. Then a few days later, we get a card from U.S. Bank saying we're -$500-n-something! We looked on our bank statements, as after we seen which creditors debited our account with automatic withdrawal, it still should have only totaled around $850.00! Then by the time we get to U.S. Bank a few days after receiving the card, they then tell us we are -$984.00 in our account! We went up to branch office, trying to get to the bottom of this, as they didn't know for sure how this happened, citing BANK BOUNCE FEES making us go -$984.00! Frank didn't even write that many checks out to get near that amount, so bank is saying they charge around THAT much for bounce fees? Seems very suspicious to me! We have another account at U.S. Bank to be closed shortly. I am getting all the money out of it as soon as possible, so to close account down. Then we can close that acocunt like one we just closed. U.S. Bank put stop payment on Closed Account for automatic withdrawals, but don't know if they can do the same for what ever little bit of money we have left in other one. Frank is getting very little Social Security check each month, so bank emptied out almost ALL he received that month. I don't make much, as jobs don't want to pay even $9.00/hour nowadays. I just wanted you to know you're not alone with the horrible deeds U.S. Bank does and how they try to get out of paying for their mistakes. For one thing, why didn't they notify us SOONER once a negative balance occurred in our account, rather than allowing us to incur another $400-n-something NEGATIVE balance after they sent us card, totalling over $900? Why did they even LET it get to $500 NEGATIVE balance to begin with? THey don't give you OVerdraft Protection, when continuing to allow a person's money to be withdrawn from a person's account, without him or her knowing it, until it's too late! We had to pay the $984 out of our other checking account, or be left not being able to open up another account elsewhere! I hate U.S. Bank! TG

Why do they get away with all this? Just think of the people that don't have computers that complain. Our US BANK used to be First Union and thats the bank that ripped me off so bad and then US BANK took over and never would help me. They doctored up their records and they get away with it. We had over $30,000 missing and still no sign of it. Thats alot of money to go missing and the bank act ignorant and not help us. That was all the money we had so we could not hire a lawyer to help us. I plan on tracking this all down one day soon, but..again, the ones that stole from us, left the bank so were sunk. CR

How can US Bank get away with so many clear and excessive rip off? I used to bank with US Bank, got robbed big time like never before from any other rip off industries out there. Last time I got rip off!! It was thursday I checked my balance and I had about $380.00 still in my bank account, no payments or checks coming in, I had to pay about 6 small different bills, 25.00 here and 40.00 there, all together wouldn't be more than 190.00, so I made all this payments on line on Thursday, mailed in a check for 420.00 saturday 2 days after I made those little payments on line, my next deposit was going to be made on sunday so they'll get it registered on monday, because the check I mailed in was to a local business. I figured they would get by tuesday or wednesday. Big surprise I checked my balance wednesday night I had been charged overdraft for all 6 small payments. I called the bank to find out why? They told me they paid the check for $420.00 and I didn't have enough funds for all other small payments, how could that happen? I paid all the small peyments on line and 2 days before I even mailed in that check. They should have paid all the small payments before the ckeck, it is clear they waited on making any small payments until there wouldn't be enough funds for payments made that week. My total overdraft charges was around $480.00. Amazing this trash getting away with it, what happend with the law? Is there any body out there who can really do anything? T

I plan to file a law suit against this bank for wrongfully tanking money from one of my accounts to cover another account that happened to be -35.00 My fault of course but Instead of taking 35.00 to cover my overdraft they threw in charges for a month and then totaled it up to over ONE THOUSAND DOLLARS and to it from my other account. Now correct me if I am wrong but if this can be done then why in the H-LL wasent it done at thne time of a simple 35.00 overdraft. Breach of Contract- The Account Agreement says customers will be notified of changes in the account agreement 30 days in advance of the effective date of the changes. ow many of us were notified of the changes effective 10/16/06? I sent U.S. BAnk a nice note and just poured my little heart out when I told them that because of their breach of the agreement, among other things like charging $2 for each $20 advanced instead of $1 for each $20 like the Agreement says, and of course charging overdraft fees on transactions that are not overdrafts, I have directed Social Security not to direct deposit my checks with them. Don't know what they're going to do about the Cash Advances on my account. Unfortunately, my available balance is insufficient to pay it...and my Social Security check can't be garnisheed...and because of a $35000.00 uninsured medical bill, my credit is shot - so I can't borrow it to pay them - so I don't know what to do about it...I'll bet they want to resolve 'that'! I had a great customer service person who helped me. He tried to argue at first. I deposited $300--they gave me credit for $100. It was Christmas weekend. I went over, but I had the money in there. As thing SHOULD be--it should have all tallied after midnight the morning of December 27, but they started charging me OD fees. I explained that it all goes into the pot at the same time. Then the oil change company pinged my card twice. There was never a double charge, but for several days it appeared to be so. In the end I would have had almost $300 in over-draft charges had I not fought my way through this. The last day there was 3 charges I have NO IDEA where they came from since I had not been using my card. I've got big money coming in, but I plan to go back to Bank of America and let them manage my funds! This is a horrible policy and think of the poor people they rip off! C.L.

I HAVE BEEN A CUSTOMER FOR 6+ YEARS. SINCE SEPTEMBER OF 2005 I HAVE BEEN SUBJECT TO WELL OVER $2,000.00 DOLLARS IN OVERDRAFT CHARGES BY US BANK. I HAVE BEEN REFUSED A RESERVE LINE OF CREDIT TO PROTECT ME FROM THIS EVEN THOUGH I HAD ONE ON MY ORIGINAL ACCOUNT OPENED AT A SEPARATE BRANCH WHICH WAS SHUT DOWN BECAUSE OF STOLEN CHECKS. I EVEN HAVE A BUSINESS ACCOUNT AT ANOTHER BRANCH WITH A $1,500 RESERVE LINE AND WAS OFFERED MORE. IT IS THE FAULT OF THE PROCESSING CENTER WHICH PROCESSES TRANSACTIONS OUT OF ORDER DAYS LATE AND ASSESSED CHARGES DAYS AND DAYS LATER. HOWEVER I STILL HAVE BEEN ABLE TO PAY THEM THE $2,000.00+ IN FEES STOLEN FROM ME. Complaint involving US Bank: I am a small business owner who has had the unfortunate experience of banking with US bank. I started my business in 1986 and banked with the most convenient bank in the area. The bank was purchased by USbank several years ago. For convenience sake I stayed with USbank because of location. US bank boasts about its customer service and the five star guarantee. As for customer service, I feel a change in protocol is needed desparately. When you use the drive thru, you generally you wait from 5 to 10 minutes before a teller assists you. Inside the bank, several employees are in the building, but they all have other duties to perform. The customer is the last in a long line to be helped. Several times I have needed to speak with the branch manager, only to be told that she is not available. The employee turnover in my branch is outrageous. As for banking services, The overdraft charges for items is $34.00, and even if you have funds in your account, they will charge you. The reason the charges accrue is because of several points. The policy of holding all of your deposits for each day until all of your debits are listed, is one way they can drain your account. For example, If you make a deposit of $5000.00 at 9:00 am they will not give you credit until 12:00 midnight, but you can have all your checks debited from your account before the deposit is posted. And US Bank is the only bank across the United States that enforces this policy. The deposits they “HOLD” are not because the check must clear first because it takes 3 Days for a hold on a check to clear. So they just use your cash for their own until they can drain your account and charge random fees. I know this to be fact because in 2006 us bank charged me $2754.00 in overdraft fees because they said I have unavailable funds and even though the moneys were deposited early in the morning with no checks to clear, I would be short in my account by change. Oopps you wrote a bad check, charge $34.00 but by 9pm my account is in good standing. What?? How can a bank legitimately steal your own money from your account and then take 5 to 6 days to notify you by mail. And then charge you for a negative balance of $7.00 for every day you kont handle the problem. I have never heard of such obsurd rules. Being a small business owner and cash flow is tight at best, how can I hope to maintain ,if my financial institution is stealing me blind? I would not let and employee do that to me, why should my bank?, with whom trust should be a factor. In an effort to correct the situation, I made several attempts to talk to someone involved with the bank, only to be pushed aside and ignored. Or even worse, treated like I am some kind of criminal trying to put one over on the bank. I have tried to understand and accept the rules at US Bank, but I am so overwhelmed by the attitude of the associates, That I could Scream. Since no one seems to care about my business and me, or my employees and their banking needs. I QUIT. I am pulling out of the worst banking institution I have ever been involved with. I am sorry to say that US Bank should be reported to every comsumer fraud web sight, office or association that I can locate. I am beginning with my local newspaper and from there I am sending this letter to any political official and legal office that will take the time to read this. I will do what ever I can to stop US bank. I know that I am not the only us bank customer that has a problem. So maybe filing a class action law suit would bring some attention to this problem. I've noticed a lot of complaints include the Banks' practice of posting transactions from the highest to the lowest. They claim this is so customer's most important bills will be paid first - but here's what they told the OCC...U. S. Bank controls in what order transactions are paid – from the largest to the smallest, which serves no purpose other than to maximize the Banks' revenue by imposing multiple overdraft fees on the Consumer's account, causing substantial injury to the Consumer: Here's what `the Banks' told the OCC – and OCC said `OK… "The Banks represent that high-to-low check posting has a positive impact on revenue and a change in the current policy would result in decreased revenues. The Banks also note that the decision to continue using a high-to-low check order of posting will help to maintain standardized practices within the Banks and, therefore, promote more efficient operations." "Additionally, the Banks have considered the impact of the order of check posting on the Banks' competitiveness.In their submission, the Banks state that the maintenance of standardized procedures within the company will make it easier for employees to handle customer interactions about overdraft processing. This efficiency will enhance the competitive position of the Banks." "The Banks further suggest that a high-to-low order of posting will help ensure that a customer's most important bills (such as mortgage payments) are paid first. The Banks conclude that the high-to-low order of posting is aligned with their Customers priorities and preferences."Oh, yeah! We all want to make getting our money stolen by the bank our first priority! Altogether now - let's email the OCC and the Federal Reserve and our state legislators - and let them know what 'we the customers' think of this...and whether or not the practice is 'aligned with' our priorities and preferences! They charged me $210 in "overdraft charges" and my account was never overdrawn. The fees posted to my account on December 5, 2006 and on December 4th, my statement shows two deposits, totaling $1300. This to me, is ROBBERY. I am looking into ways to file a class action lawsuit against USBank. Based on all the complaints I have found on the internet, I don't think I will have any problem finding other people to join me! By the way, I am a single mom, just trying to plan a wonderful Christmas for my daughter. $210 is A LOT of money to me. JH

Why don't you all go to the Office of the Comptroller of the Currency website - and file a complaint? Maybe if they get enough complaints, they'll do something about the unfair and deceptive banking practices of U.S. Bank. At the least, they'll earn their pay...and we'll get to vent to someone in a position to do something about it. Also, 3 Bills concerning the order US Bank (banks in general) use to pay items presented for payment, one to require notification - before a transaction is authorized - that the purchase will cause an overdraft, and the other a general consumer protection bill. They are HR 4115, HR 4114, and HR 3449. Start calling and writing your legislators - getting on their rear-ends to get these Bills out of Committee and onto the Floor for a vote! We aren't helpless, people. We just need to get off our rears, quit complaining, and do something about it! I've posted the complaint I filed with the OCC on my website - and say a daily prayer that US Bank will try to sue me over it! Say a little prayer for me, da da da... Oh - my overdraft was $ 1.59 on one purchase - and the final charges ended up being 19.3% of my Social Security Disability check! So I've used their cash advance feature for $ 380.00 - and am giving serious thought to just stopping the direct deposit of my checks after learning they changed the account agreement a month ago - but don't bother to notify customers as they say they will in the old account agreement. Don't know how they'll collect the cash advance from me, but hey, I'm old enough I don't much give a rat's behind what they try to do! Guess they'll just have to set it up on an easy payment plan. I think I can afford $10 a month if it's interest free. Lots of issues with these jerks!TOG

I have been with my branch for 28 years and found out how much that was appreciated. We attempted to do a electronic transfer to pay a credit card debt. We received an overdraft notice on an account that was not specified for payment on the credit card and had never been used to pay the credit card in the past. A check with the credit card company showed the right information and there attempts to receive payment. A visit with our branch was met with my wife having to wait while the representative visited with her grandchild. My wife was then met with hostility as there was no way US Bank could have made errors like that. When asked how the credit card company could have possibly got an account number they had no record of she had no answer but to dismiss my wife. This is the way that they treat customers who consistently run 5 figures through their accounts per month and have stuck with the same bank for 28 years. We have now switched to a different bank and were amazed at how differently we were treated. We didn't even mention our US Bank troubles but all who found out where we banking stated we were joining a growing list of people in our town. Thanks US Bank for making the choice to switch so easy for us. IBA

Since August of this year, I have been at war with U.S. Bank over $1200 in fraudulent, unauthorized charges made in Europe to my daughter's Visa Buxx card (which has not left the United States this year). Here is my first letter:

"Dear Mr. Grundhofer:I write to describe your abysmal customer service before I contact attorneys to initiate a class action lawsuit against U.S. Bank for damages arising from your failure to honor your contact with your Visabuxx holders. My story is simple. On August 9, 2006, my daughter found her Visabuxx account drained of money. She immediately notified U.S. Bank by calling the customer service number on the back of the card. She was told at that time that she would be sent a form to fill out to document the fraudulent transactions that she identified. It was not difficult to identify the transactions, as we live in Santa Monica, California, and they all were processed with merchants in Europe. The form for reporting the fraudulent transactions never arrived. Indeed, we received several letters dated August 21, 2006 in a single envelope from your company stating that we would be contacted if any further information was needed. See Exhibit 1. As an attorney who has represented banks, I remained concerned about these charges and contacted your company on August 31, 2006 to inquire about the status and whether I needed to take any further action. On that date, I sent two emails and a letter, in addition to spending several fruitless hours on the telephone with your customer service representatives who could not answer (and still cannot answer) my questions. My August 31 communications are attached to this letter as Exhibit 2. Following my August 31 communications, I received the emails attached as Exhibit 3 to this letter. As you can see, in each instance, I replied immediately to any communication from your company. The reverse was not true. In addition, I was repeatedly assured that no further action was necessary on our part to facilitate investigation of this matter. On September 11, 2006, I received five letters from your company concerning the fraudulent transactions. The letters were all dated September 3, 2006. The single envelope containing all of the letters was self-marked and dated September 1, 2006. Let me emphasize that these letters did not arrive at my home until my regular postal delivery on the afternoon of September 11. Exhibit 4 is a copy of those letters and of the envelope containing them. In the letters, you imposed a deadline of September 11, 2006 for us to respond to an August 18, 2006 letter that we never received and that was mentioned for the first time in the September 3, 2006, letter despite our many inquiries concerning this matter. I replied via facsimile the same day, September 11, 2006, and called your customer service line as well. See Exhibit 5. Finally, on September 11, 2006, at 10:30 p.m., Sabrina, CSR # 2865, agreed to fax to me the fraud forms within 24 hours. I received the forms the next morning, September 12, 2006, completed them, and returned them to you via fax the same day. See Exhibit 5. Indeed, the very fax number included on all of the letters and on the fax cover sheet was not operational so I had to call your customer service line again on the evening of September 12, 2006 and was given a second number. I immediately faxed the documents to the new fax number provided, as well as to the fax number shown on your fax cover sheet. Even then, I was requested after speaking to the supervisor, Sam, CSR #2541, to resend the faxed forms to second number (953-377-4438) addressed to Ormela Prashad. I complied with this request as well. See Exhibit 5. It is now September 13, 2006, and my account still has not been credited for these fraudulent transactions despite countless hours on the phone with numerous customer service representatives. This transcends fraud; it is theft. Your company has breached its cardholder agreement and Visa's no loss guarantee. It also has committed mail fraud. I am able to document my side of the story, as you can see. Can you document yours? I have not spoken to a single customer service representative of your company who is able to produce the "August 18, 2006" letter referenced in your September 3, letter. If a letter was sent on August 18, why on August 21, 2006, two days later, did you say "if we need additional information from you in order to perform our research, we may need to contact you"? As I stated above, I am a lawyer with experience in dealing with these matters. An ordinary consumer with a 9 to 5 job and no legal training would be utterly at your mercy. By copy of this letter, I am notifying the California Attorney General, the Federal Reserve Board, Visa USA, and any consumer or media group that is interested concerning your shoddy practices."
This was not the end of the story, however. The rest is contained in this letter to the OCC and the California AG:
"This letter supplements the above-referenced complaint. As you may recall, we submitted forms to the bank identifying five fraudulent transactions on September 12, 2006. We received form letters from the bank acknowledging receipt of all of our dispute forms in September. On October 20, 2006, we received 4 (four) additional letters from the bank concerning four of the five fraudulent charges. These letters were dated October 13, 2006, but the envelopes transmitting those letters were dated October 18, 2006. See Exhibit 1. We responded to those letters on the date we received them, October 20, 2006. On November 1, 2006, I spent 3 (three) continuous hours with customer service at the bank concerning my daughter Hilary's account, which I could not and still (two days later) cannot access online. I was informed by the bank at that time that we received credit for the four fraudulent charges relating to the four October 13 letters, but that one of the charges, for $212.76, had not been permanently credited to our account. We have received no additional correspondence from the bank other than the September acknowledgement of our dispute form concerning this charge. We disputed this charge substantially more than 45 days ago, the maximum time allowed by the customer agreement. As I informed your representative, Electra, on November 1, the customer service practices of U.S. Bank regarding their prepaid cards amount to a "no customer service" policy. Victims of fraudulent charges are given a customer service phone number that connects the caller to a customer service center in India which has no direct access to the disputed charges unit in Fort Lauderdale, Florida. We the consumers are unable to discuss these fraudulent charges or the actions taken thereon with anyone in this country who has access to the paperwork concerning the fraudulent charges. In short, the entire system is designed to frustrate the customer into acceding to the fraudulent charges rather than disputing them. In my case, this has been exacerbated by my inability to access my daughter's account online for three days without any explanation from the bank. I understand that many employers now use these prepaid cards to pay the wages of their employees. I suggest that the OCC examine the safeguards implemented by the issuers with respect to unauthorized charges before allowing widespread use of prepaid cards for employee wages."
Unbelievably, I still cannot access my daughter's account!!! Of course, we are closing her account when it is empty. S
UPDATE: It has been 15 days since I have been able to access my daughter's account. Yesterday, I was told there were ten fraudulent charges reported to the account. It took me half an hour to convince the CSR supervisor that only five charges were reported and that US Bank Visa Buxx somehow had generated duplicate charges. I still have not received credit for the fifth transaction that somehow the chargeback unit forgot to process. S

I can't believe I am reading all of this. I had never had a problem with US Bank in the 5+ years I've been with them...until yesterday when I found $186.00 in overdraft fees that they charged me in error! I am still fighting it. I am surprised to see that this is also happening to so many other people. At least I'm not alone. FG

My experience with US Bank has now officially begun! My boyfriend and I have paid over $375.00 in O/D fees in the PAST MONTH. Keep in mind I have banked with: Citibank(still do), Bank of America (still do), Navy Federal Credit Union, First Midwest Bank, Great Lakes Credit Union, TCF (don't ask) and Amcore Bank. I was an employee of Amcore's for 2 years. I am VERY familiar with banks and banking systems. In all the 12 years I've been writing checks I've "bounced" two checks. I'm not a saint. Won't believe I am. I've actually been published in the newspaper for my Checking Systems Savvy. However, US Bank is dead set that the problem therein lies with ME and my inability to manage a bank account?! I'm disgusted beyond belief. If you are an online customer...forget it. The balance and available balance and this that and the third that goes on on that website throughout the course of the day...is DECEPTIVE. I want to know are consumers filing lawsuits? Where can I look on the boards here to find out information. I'd be more than interested in doing my fair share to bring a class action suit against US Bank. This has to stop.T

I too was just screwed by us bank recently and in the past. I have payed about $500-600.00 of my hard earned cash, for ridiculious overdraft fees. Half of these fees could not all the way be explained. The other half they would lie about service charges or how the companies were not sending the information through. I have had a least 5 different accounts opened and closed with this company because of fraud or the bank just not paying attention of what was happening or what had been noted on the account. I have filled out numerous of fraud information and faxed it back or sent it back. In the meantime they keep the fraudelent account open and state it doesn't matter if it's open or not while there doing the fraud investigation. In the meantime your fraud account and your new account are accumulating $7 a day until they can figure out the problem. So you end up paying on your brand new account, overdraft charges from the old account for the fraud investion. I had that happen twice within the last six months. I had a fraud account that was suppose to be all taken care of and closed out. They opened a new account up and sent me out a new debit card. Before I could even get the card or even look at my account they had added 4 overdraft fees of $35 dollars to it. It was a brand new account that had not been touched. S

I worked for US Bank (big mistake) and if you think they screw their customers, just imagine how screwed their employees are!!! One of my biggest problems is how they take advantage of people in need. They will fee you to death! If your account goes into a negative available balance they will charge you on overdraft fee and then when they item actually posts to your account they will charge you again! 2 fees for the price of one!!!!!! Not to mention the NUMEROUS unethical people who work there! They have a system that will allow you to book a credit card for a customer with 1 click on the computer, do you know how many people are out there who now have a US Bank credit card that NEVER asked or wanted one???!!!! It is just ridiculous the things that go on continually but I don't have all day! J

We have banked with US Bank for many years because we like the people at our small town branch. Stupid, I know. We have had a series of small bad experiences, but, frankly, we just rolled over, much as one might do with a car sales person, whom we know is full of crap, but we just say, "Oh well. It's just the way it is." "Oh, well, bankers are all sharks." Now I've finally had it. We saw a good interest rate advertised for a home equity loan and we stupidly took the bait. Again, we knew the local people and surely they would not cheat their neighbors. We were quoted a monthly intallment payment, but, when we showed up at the bank to sign the papers (a few days before our first payment was due to a home remodel contractor) the loan amount was more than what we had asked for. It was explained to us (and I did ask many questions) that we were being extended an additional line of credit. I asked (several times) that, as long as we did not used that extended amount, would the original intallment portion of the loan remain fixed, and our payment be at the rate agreed upon? Yes, the loan officer said, at least twice. Now, 3 months later, the amount we pay varies every month. I have complained to our loan officer that this was not what she had explained to us. Every month she has another excuse for why the amount is varying on a supposedly fixed loan. But the truth is all too clear. She simply lied to us, plain and simple. Will I ever learn? NEVER sign even if the person tells you what you want to hear. We were naive and stupid to trust the person's word. They know that, by the time you are signing, you probably need the money. We should have walked out and gone to another source for the loan. I WILL NEVER do business with US Bank again. They will lie to your face, even if you bank at a small town branch. I opened an account with US Bank 3 years ago because a buddy of mine worked for them. My buddy was fired about 2 months after I opened my account because money was missing from the safe. However, they acknowledged to him that it wasn't his code OR key to the safe that was used, but they thought it was him so they decided to 'terminate' employment. After hearing this, I almost immediately closed my account. Further though on the matter said I needed a bank account and as long as they don't screw with my money I don't have issues. How wrong I was... I couldn't even begin to explain how many times I've had unwarranted overdraft fees and how many hours I've spent recovering lots of $$$$. Each time I just 'gave them another chance'. Dumb ass decision on my part. I got divorced early 2006. I called the 800# (because the nearest branch was about a 2 hour drive from me) to have my ex-wife's name removed from the acct. They say that could only be done with a copy of the Divorce Decree stating that the acct would be my property. I faxed it, they "didn't" get it. I sent it CERTIFIED mail WITH RETURN RECEIPT...they "didn't" get it. (Yes, the post office did send me a signature card. Very easy to read and see.) Further contact with managers state I have to close the account and reopen a new one. I tell them to do that. I get a letter in the mail stating my request was denied, with no explanation. I didn't have the time to deal with it. I work more hours a week than the bank is even open. So April rolls around. I've moved to an area with lots of branches and I go into a branch and open a new account. Waiting for a direct deposit, I held off on closing the other until that cleared and I could be assured that my company would have the new info in time for my next DD. May - I call the 800# and close my account. (I had a zero balance.) The lady said she had to record the phone call for security purposes and to confirm my request. She then issued me a Confirmation # that my acct was officially closed. I get home, logon to internet banking, and sure enough, the old account is no longer showing. I figure everything is fine. WRONG!!! July 19-I start a new insurance policy. Confirming that the down payment amt was correctly entered, I logon to internet banking. My account is -$240.00! I had over $1,000 in there the very same morning! There was a very strange transaction on the screen that simply said "Transfer to: For OD/Rr/Ma" for over $800! Went down to the branch. (The branch's hours said open until 6pm. At 5:15 the building is dark and locked.)IMMEDIATELY called the 800#. The banker immediately got rude when I said "Unauthorized Withdrawl" to him. After being on hold for 10 minutes "while he figured it out" he comes back and says that the money was transferred to my OLD account because it had a negative balance. I explained to him that the account was closed, gave him the Confirmation #, and asked how to obtain the recorded copy of mine and the teller who closed my account's conversation a month earlier. He says nothing about the recording but proceeds to tell me that I overdrew my account and they to! ok the money to cover it. I asked for a supervisor. After waiting on hold for 20 minutes, a supervisor gets on the line and begins explaining arguing with me that the account did not close. During this time, I logged on to internet banking to pull up the terms and conditions to rub in her face. GUESS WHAT??? MY CLOSED ACCOUNT MYSTERIOUSLY SHOWS UP WITH A NEGATIVE BALANCE!!! I clicked on it and sure enough, they didn't close it and when my "monthly fee" hit, they charged me OD fee on it! Plus a $200 "check" that I didn't write...OD fee on that too... Well you still have to add in the $7 DAILY fee they add if your acct is negative. THEY DIDN'T EVEN SEND ME A F***ING LETTER IN THE MAIL STATING OVERDRAFT! She refused to credit the money. Refused to let me speak with a higher ranking employee. She refused to do anything. After telling her I had all night to fight, she says she does too and will not refund US BANK'S money. I told her it was my money, and that they had no reason t! o just take money for a closed account WITHOUT contacting me f! irst! Th ey will never see another dime of my money ever again! Sorry for the long post, but I had to share my distaste for these assholes as well. US BANK - You'll see one day what happens when you do this to millions of people. While trying to open a checking account with our local credit union, my husband learned that someone had opened a checking account with US Bank using his social security number but another name. US Bank had closed the account due to account abuse and reported the debt to Chex Systems. Since our bank uses Chex Systems, we were denied the account. We called the fraud help line and they were little help. When I called to ask for a number and address to a local branch so that we could send an affidavit of identity theft, the US Bank representative rudely told me that she did not have to speak to me because my social security number was not compromised. I only wanted general information so that I could solve the problem. I wanted to be sure to send the correct documents to the correct address, not acquire sensitive information about the potential perpetrator. The conversation went nowhere. Finally, my husband called a local US Bank and was transferred to the Branch Manager. He asked him how this could possibly happen and whether or not they actually compare social security numbers with names. The Branch Manager stated that US Bank does not ask to see a persons social security card unless that number has a history of account abuse. They do not check to see if the name and social security numbers match. The way we understand it is that the account is opened even if a bank official notices that the social security number and name do not match. When asked if he would consider changing the policy regarding mismatched names and numbers at his banks, the Branch Manager stated that his institution would not change the rules unless forced to do so by federal law. This US Bank employee laughingly told us to go ahead and tell the world about their practices because nothing will change until the law changes. Maybe he's right...so, I've been spending a lot of time writing local politicians and starting a blog. I even contacted a local news personality who actually urged me to take it to the State Attorney General's office. So, now I'm waiting to speak to the authorities. The worst thing is that this individual had an account closure due to a negative balance. After reading about their shoddy accounting practices, I realize that he may be a victim too. In a sense he already is because we have learned so much about him, his identity has truly been compromised. We even know that his social security number is one digit off from my husband's number. So, there is the possibility that the bank didn't enter his number into the system correctly. They deny that this is possible - but- if they actually cross referenced names with social security numbers, they would have caught the mistake. US Bank gave me a counterfeit $100 bill! You'd think that a professional that handles money all day would be trained to detect a counterfeit, right? Apparently, that's not the case with US Bank. My husband and I withdrew $4000 in cash on August 5th, 2006 from the Lake Forest, CA branch of US Bank. The teller's name that handled the transaction is Chris Watson. When I went to deposit those bills in another (Bank of the West account on August 7th, the BOTW teller looked strangely at one of the hundred dollar bills (still in the US Bank envelope). She then went over to show it to her manager and he subsequently came over to inform me that it was a counterfeit and that he was obligated to confiscate it. Now our account with US Bank is not insignificant. There is a great deal of money that goes through that account because of several properties that we rent out and have refinanced. I understand that there is not verifiable proof that the bill was one of the ones that the US Bank teller gave me (other than the sworn statement I gave to the Secret Service under penatly of perjury) but you'd think that at the very least, they could have given me some amount of professional courtesy. When we went to discuss the matter with the branch manager, Betty Patten, all she would say is that once we walked out of the branch door, it's not their problem. Even if she had said, "I'm so sorry that this has happened to you but unfortunately I have no recourse within my capability to alleviate your loss," we would have walked out bummed thinking that some evil counterfeiting criminal had stolen $100 from us. US Bank intentional overdraft - Facts: On 7/24/06 I had + $28.76 balance, I deposited 7/25/06 $120.00 with a balance of + $148.76. I was charged 2 overdrafts totaling- $70.00 and a charge of debit of - $29.95 leaving a balance of + $48.81. On 7/27/06 another overdraft of - $35.00 leaving balance + $13.81. I called the bank thinking $29.95 and $1.00 was fraud which I have reported to FTC and the USBANK. $29.95 + $1.00 is being refunded. There was a presentment of $19.40 which was credited where I now have $33.21 in my account but not the $105.00 the bank said it would take 6 weeks to credit my account if I prevail with the credits. The bank reversed previous OD causing same issues on 2 other occasions. The one last month, June 26, 2006 was over a March /14/06 deposits of a non-cash item $100.00 MO which caused 3 OD on $5.92 and $.99 charges totaling OD charges $93.00 without an explanation which overdrew my account which I believe is unfair trade practices and is a predatory practice. I have the statement to send you. I’m sure they will refund the $105 but this practice is wrong and tortuous, intentional. RN

I have been with Bank of America for 14 years and never had these kind of problems. The reason I onpened a new account at USBank is because I moved to Colorado and there isn't any Bank of Americas here. I am on a fixed income and on disability. I signed up for a service called Grant Search Assistant as they said I would have 14 days trial to try their service. The service turned out to be help doing grant writing, so I canceled the service. Then I went about doing my normal banking transactions bought a soda at the gas station a couple of times and a few other low cost things. Then I find a couple of days later. That I am overdrawn by $8.50 and that I have 7 overdraft fees of $31 each, because they took and held money in promise to this Grant Search Assistant which was the last thing to post. So for 6 of those overdraft fees I had the money in my account to pay those transactions, accept they took and held that money for a service I canceled, and since I'm on a fixed income I couldn't put money into the account to make it to where it wouldn't be in the negative, so they are charging me $7 a day neg balance fee. So far they have charged me $342.50 in fees for being overdrawn $8.50. I have brought a dispute against the GSA service, but they are telling me it is my word agaist the GSA's. I also went to the bank last week and tried to talk to them and they told me they would take off $100 of those fees if I could come up with $175 to put my account into the positive, so I barrowed the money and put it in and they never took off the $100 dollars of fees. I asked them why and they said since I disputed on the phone they can't do anything untill the dispute is settled and that if I lose the dispute I am going to have to pay all of the fees. Today I just took my rent ib cash into a bank branch and brought my account into the positive by $.50, and now I just looked online at my account and it says the deposit is pending when I gave them cash. So now I'm worried they might still charge me the $7 fee for today and put me in the negative again and I dont have any more money.HF

USBank is a rip off. If you have a deposit and a check sitting side by side and you do not have sufficient funds to cover the check unless the deposit is posted, USBank will bounce the check and charge you $35 and then post your deposit. I think this is unfair. If you have a deposit, the deposit should be made first then the check should be presented. MJM

US Bank offers "free" checking for small businesses just getting started. They act like they really want to help the small business owner but when I visited the Beverly Hills US Bank branch to open the account, the rep said after inputting all of my information into the computer, "You know there is a $300 fee to open this account, right?" I asked, "Where does it say that on the website?" He said, "Probably somewhere in fine print." I walked away. CH

I made a mistake on my bank account. I under calculated the amount of checks and debits I had pending by $1.85. This $1.85 error is now costing me $70 in overdrafts fees. I realized my mistake last night. I rushed to the bank first thing this morning and deposited $2. My account did not show overdrawn. How can they do this? C

For the past 3 weeks I've had the same problem with US Bank. They charge me overdraft fees on items pending that have not been sent through the bank yet. I made a deposit through an ATM and they put that on my account as pending but told me it was not available and then proceeded to again charge me overdraft fees. Anyone from around Berea, Ohio????? I have been screwed by this bank for the last time. 2 times before I have been hit with over draft charges on a positive balance account. I caught the bank in itself tripping over their own lies. But, who was I...just a poor customer so who was going to listen to me over a measely $150. Always treated like it was ME who made the mistake, when it was clearly THEM who were in error. I even went to the corporate office, and got so much run around there I felt like I had run a marathon! Both previous times I ended up laying down and just giving up. It was just too much trouble fighting a big bank, and way too much trouble switching banks, which would entail rearranging all my billing, payroll, etc. So I stayed. Well, F that! Once again, I am going to be screwed! I have an account balance of 93.00 to which my direct deposit pay was added to, plus I deposited 2 checks for a total of 732.00. I bought 16.41 worth of gas on my debit card, and paid out 307. in bills? I should have some $$ left, you would think???!! Nope, not only do I not have any $$ left, but I am over drawn! $115. overdrawn plus fees of $30. each times 3, for a total of $205.!!! Yeah, for a single mother working her butt off and going to school full-time and busting her a** to feed her kid, & this bank thinks it's OK to screw me! I am searching for others who have been raped by this bank and who may be interested in a picket of the branch in Berea, Ohio, or anywhere else in the Cleveland area. Overdraft Fees on a positive Balance -What the heck? I didn't believe it until it happened to me. 6 overdraft fees in a row, even though my account was positive. I was a faithful customer of US Bank, and I ran my private checking account through them for my small business. Through one of my customers, I recieved a check for about $4,000. I called check verify services to verify the account, cleared the name, and even the funds. For extra precautions, I deposited the check and agreed to wait the 5 day holding process rather than cashing it. A week later it cleared, so as any consumer in the US, I began to spend a few hundred here and there. I go into the bank to withdraw a large amount of money and the branch manager wants to speak to me reguarding the check. She informs me that the check is a fraud and will be coming back to me. My first thoughts are, okay, I'm not paying back any money this banks "supposedly" cleared. The conversation went sour and they were going to close the account no matter what. To make it worse, all the purchases I made with some of the money from that check, they held for authroization until they recieved the physical check back (even though they already knew it was a fraud) so now I am stuck with about $300 in overdraft fees. Here's the icing on the cake....they assumed I WAS PART OF THE SCAM AND REPORTED ME TO CHEXSYSTEMS INC...I will not be able to open an account anywhere for up to 5 years. Overdraft Fees- Thats what happened to us. Our bank account showed the balance we knew we had. The US Bank Robbers charged us hundreds in overdraft fees by the time it was all over with, even though our account was in the positive according to our records. It ruined us for 2 solid months. I have never had a bank account that I had to BABY-SIT just to make sure we didn't go into overdraft. Then they have the gall to have some snooty employee call us to tell us we were in overdraft. After that, we went to deposit a check and once again, the teller was so rude and disrespectful- she asked, in front of everyone, if we wanted a copy of our overdraft bank account statement- as if we didn't know the condition the bank put us in. Ok..I'm so MAD! Did you know that IF you have a charge put on your debit card, whether it be as a debit or a credit, USBank will hold the funds and not pay them out...AND if you are overdrawn for that amount before your deposit goes in they charge you an overdraft fee? Your statement will read that you had NO overlimits...it will not show a negative balance. But when you confront them with this fact, they tell you that they showed it in "their" records and even though it was NOT paid by them, YOU spent the money before they could deposit your check in your account. THIS IS FRAUD people...how many of these will we continue to pay before there is a class action law suit against this bank?? Also...beware of any transactions which retailers might make on your card. Unlike ordinary credit cards where they are immediately canceled if an error is made, on a USBank debit card the error is taken out of your bank balance, , and not returned for several banking days! I purchased a car with my boyfriend on 05/03/06 and US bank put me on the loan and not on the title of the car. I have tried to correct the problem several times with the dealer and they REJECT my request everytime, yet they keep me on the loan. I have done eveything they requested of me but they continuously reject my request to be placed on title of this vehicle. the story goes on. I HATE US BANK and they will never get my recomendations to anyone. BB

So We checked our ATM checking statement and it determined that we had enough money to buy lunch. So we bought lunch.($6) We check the ATM occassionally because of an incident that happened before, imagine that! Anyways we checked the ATM again and it determined we had enough for gas. I have 4 accounts with US Bank. One is a "free checking" account. That account earns about $ 0.12 per quarter. About 2 times a year I am charged an "Analysis Service Charge" which negates the interest I might have earned. The bank says "We probably have another account that will better fit your needs" BS!!! I have a VISA account with them as well. I paid it off over a year ago but I overpaid. They left it in there, to the tune of about $75.00. I was never paid interest on it, but they would send me a bill every month "Do Not Pay!" So, when I finally transferred the money to my checking account, they charged me a $5.00 transfer fee. That really pissed me off! I have written them, talked to them, withdrew $13,000 to put into another bank at 3.67% interest in a money market account. I went from earning $2.81/quarter to about $400 per quarter. I intend to close my accounts due to the way they treat their loyal, over 30 year customers. D

I am a former US Bank employee in Southeastern Wisconsin. Unfortunately, the bank does NOT stand by their word!! As an employee, we were always told that employees were their greatest customers!!!! This was so not true!!! About a year ago, we got a new district manager (a real bitch) who came in and changed everything!! People (customers and employees alike) got screwed, screwed, screwed. This is what happened to me: I had a coworker order checks for me... these checks never came!!! One day, I was checking my account and I noticed that some of these checks cleared. It turns out that he ordered the checks with MY account number, however someone else's name and address!!! That overdrew me, so I received $34.00 charges on top of it!! I never got those funds back. I was threatened with disciplinary action (off the record, of course since that would be so illegal) if my account was not brought positive. About a month after that threat, my account charged off. A few days later, I was fired. HMMMM.... COINCIDENCE???? Also coincidence that I was just told that "I no longer had a place in the company and my employment was at-will, so no termination reason need be given." IHUSB

Warning! If you have a US Bank mortgage, call them ASAP and tell them not to destroy your personal check and to send it back to your bank. Also tell them that your check does not authorize them to do anything but cash it, not a ACH (electronic transfer). Your cancelled check is your only receipt to prove you paid. They have already pulled the 'Your check was late crap', and without a copy of my canceled check I would have been out a mortage payment and three months of late fees. It feels good to hear the US Bank rep skirm on the other end of the phone. This Check Processing Notice on my mortage statement feels wrong, it feels like a BIG wrong. W

Just a couple of weeks prior to Christmas, US Bank popped me with 11 overdraft charges. They took Christmas from my children, heat from our gas heater and respect from this customer. Granted, they did put $200.00 of the $497.00 taken to cover less than $50.00 worth of small transactions and $2.00 fees, even a penny will cost $34.00. Of course, they made me beg and plead while telling my how I need to use the secret blue link that makes absolutely no sense. There is some financial genius at work, or total idiots if you ask me. I only hope to win the lottery or inherit a fortune. I have a couple of automatic deposits pending keeping me in their system. Please spread the word - U.S. Bank Sucks! I am submitting the letter sent to Grundhofer about our problem with Us Bancorp. I have also added an update on where we are with US Bancorp - They should not have US in their title - they certainly don't work with the American people. How will I know if it is accepted? If this is too long, will I be able to shorten it some. Like those that have posted here, we feel US Bancorp has not dealt fairly with us.

2-14-06 Update on dealings with US Bancorp
We have now had two responses from US Bancorp. 1. Local branch -They will not help because of our current delinquency (4 months) – As I have stated to US Bancorp people this would not have happened if we had we received the correct information in October of 2005. At that time we had other options to look at. The lack of consistent payments on our existing Line of Credit – is a complete lie. I have copies of all checks that were ever sent to US Bancorp and we have always paid each months amount on time. I can not help when US Bancorp chooses to enter the payment into their records.
2. A letter from CEO Mr. Grundhofer – We regret that you feel as though you did not receive the level of service that we wish to provide to all of our customers. ….. We understand that an unacceptable payment arrangement may have been offered ……. But, it seems that it is our fault that and not the fault of US Bancorp for the incorrect information given. They have done their part.
We feel strongly that US Bancorp has violated our civil rights. US Bank does not really care about their customers. They profess to all the ethics that a person would look for, but follow through does not exist. Three Hi-Gear Marketeers, LLC

I would think that it would be good policy and good public relations to be sure that all the people in your banking areas know what they can and cannot do. If they cannot answer a question or solve a problem, they should not be telling a customer that a certain procedure will be fine. I have been working on this problem since October 2005. I thought I had the problem solved on October 24, 2005. That was not the case; in fact it was just the start of the problem, which continues to today, 1-26-06. We realized in October we would have some money problems, due to the fact a partner left. This partner left a deep financial problem in our business, due to his actions. On 10-24-05, I called and talked with _____ (no one ever gives their last name). I asked if it was possible to pay just the interest for about three months. I was told that was fine. A payment of $408.57 came out of out account on 10-28-05. If I had been told, at this time that this procedure was not available, I would have immediately started looking at other options. No one told me, until January 2006, that the credit line could be rewritten. WHY NOT? On 11-5-05, _____ called about a past due payment. I explained everything again. I was told at that time US Bank did not have a policy that would allow that type of payment to be made. I was passed from one person to another. Each person told me the same thing as _____, but no one had any idea how to help me solve the problem. The last person I talked to told me to contact my local US Bank branch. On November 9th and 10th I spoke with __________ at the Appleton, WI branch of the US Bank. I explained the entire situation. He was extremely surprised to hear I had been directed to the local branch. _____ told me he would check into everything and get back to me. On 11-14-05, when a _______________ (user ID _____) called about the payment, I had to re-explain everything again. Again on 11-28-05, a payment of $408.57 came out of our account. When ______ did not return my call, I again called him. He stated that he had contacted the Small Business Center and they were to have contacted me. They had not contacted me and he said he would talk with them again and have them contact me. On 12-21-05 I called _____ again, as I still had not received a call from the Small Business Center. He stated he would contact them again. On 1-3-06, I called _____ again. He was not in. When _____ returned my call on 1-5-06, he gave me the number for the Small Business Center – 651-205-2197. I was to talk with a _____. This was supposedly the place I needed to get some help in solving the problem. When I called, I talked directly to _____ and explained the problem. She promptly told me that I did not have the correct office. She gave me the number 888-780-3996 and the name, _____. I called and talked with _____ and she informed me that I still did not have the correct department that could help. _____ again sent me back to the local US Branch in Appleton, WI. On 1-6-06, a _____ called about the past due payment, reminding me that I did not want it to pass 120 days. I again explained everything. I told her I had contacted the Small Business Center & was referred back to the local branch. She stated that it was her department that handled this type of problem. I had only been asking since October 24, 2005 for the correct department to handle the problem. She explained two ways to handle the situation, one way which was the Project Gold. This was the first time that I heard about the way to rewrite the advantage line. I called __________, Branch Manager, of the local US Bank in Appleton, WI. I briefly explained what we need to do. _____ faxed me the papers. She also informed me that the Advantage Line could be rewritten for Prime (7.25% + one.) Or it could be written as a fixed 7.25% with collateral. I have received calls almost everyday, since 11-5-05, from someone at US Bank. It seems that no one reads the statements I that have given or no one has recorded anything that I said. Everyone wanted another explanation. One person I talked to actually said I did not look in the files. WHY NOT? The most recent calls have reminded me each time that I did not want to go over 120 days owing a back payment. I was told it would then be written off as a bad debt and I assume that this means it would go to a collection agency and our credit rating and reputation would be severely damaged. I have received letters that have threatened collection action. All of this for a problem I have been trying to solve since October 2005. I did not wait for US Bank to call me about a back payment. I called US Bank wanting to work out a solution before my payment became a problem. I would think it would be in the best interests of US Bank to work out a solution. US Bank wants their money & we want to pay the debt. We do not like the fact that we owe US Bank money. We want to solve the problem and pay what we owe. I have been working to get this problem solved since October 2005. We want the lower interest rate. We do not intend to use the US Bank credit line again. We simply want to pay off the debt. When we have completed our obligation to US Bank, we will never again, do business with US Bank. We have not received the correct information, from US Bank, since October 2005. I have been sent from one department to another, one person to another, with no one having the correct information. This has been pure frustration on my part and a complete waste of our valuable business time. I do not feel that I received the type of service that I should have received from US Bank. And, this is not the first time we have had problems with US Bank. In 2004 we had a problem when the Advantage Line was renewed. I wrote at that time. Now I am sure if our name were Donald Trump, there would be no problem rewriting this line of credit ($48,000.00) with a low interest rate even we owed one billon or more. I am sure that for special groups and specific people, lower rates are given than what I have been quoted. We are not Donald Trump, but we de feel we should be given the same courtesy and respect that would be given a Donald Trump. We did not receive the correct information and the constant threat of other action has been there since November 2005. November is when we found out that the solution we thought had been put in place in October 24, 2005 was not valid. We are left with many questions, once again about how US Bank handles everything. Any trust, we still might have had in US Bank, no longer exists. We simple want to work out a payment plan and pay off what we owe. We will never do business with US Bank again. Nor would we advise anyone that asked us, to do business with US Bank. I have been trying to solve this problem since October 2005. I am writing the OCC and sending a copy of this letter. US Bank has lied and stole from me way too much. I just hung up the phone with a us bank "supervisor". This supervisor actually called me a liar on the phone. They have been screwing me with overdraft fees for months now. They will show a balance on there internet website and then next thing you know you have overdraft fees and a different balance. These people are nothing more than common criminals. I asked them if there website shows a balance of 100 and I make a purchase for 80 how can I possible get an overdraft charge. There response is that that was not the available balance that I need to go off of my checkbook ledger, yet in the same breath they will tell me that they post things in the order that they want, not me. How can I go off of my ledger if they post things in the order they want, yet I cant go off of there website because that is incorrect. This has got to be the biggest scam, racketeering, deceptive thing I have ever heard of. KC

We regret having to take this action, however, you failed to make on-time payments on the above-referenced Business Card account pursuant to the terms of your Cardmember agreement. I am 55 years old and started a business that unfortunately did not do well. I have withdrawn my entire savings to try and keep up with my financial obligations but have no more resources to draw on. What a nightmare to receive that letter. Small business people BEWARE!! Holding government checks - I finally got my account closed yesterday after only having it open for three weeks. I have never been treated so rudely before in my life. I had just moved to Toledo Oregon and opened an account at US Bank at the Newport branch. The bank manager Sherrie Payne-Marvin herself opened my account. The funding to open my account was a child support check which I receive each week and greatly depend on right now since I just moved and do not have employment. I was told by my boyfriend who had opened and account there that they have a five day hold on checks which I mentioned to her. She said yes, but government checks are available immediatly, the teller puts them on a "special" deposit slip. All was well or so I thought. The next week I deposited $187.90 worth of child support checks at the drive up teller. Then went to go buy diapers, food, etc. Later that day I checked my balance online and it showed they charged me an overdraft charge of $30.00 even though I had a positive balance of $327.10 (available balance $164.33). Why???? They could not tell me anything other than my account was overdrawn. What made it over???? and why did it show a positive "available" balance??? I checked my balance again when I returned home only to see that they had NOT made my government checks available immediatly, they were holding the $87.90. Being that it was now after 5pm I had to wait until the next day to get answers. I returned and pointed out that my check was being held and it was not supposed to be...she coped an attitude and said I have to tell the teller to put it on a "special" deposit slip. !!! I was not told that when I opened the account, only that the "teller puts it on a special slip". So now it's my fault? I asked about direct deposit, and found that they dont hold those so I had my child support DD. Should have fixed the problem, right? NOPE.That deposit was made at 11am on 01/06/06. I watched my balance for 8 days and the 87.90 STILL had not become available. That racked up another $102.00 in overdraft charges. Charges that would not have occurred if the teller had done what I was told she would do. Finally 01/17/06 the $87.90 posted, but only brought my account to -$.96. Overdrawn again. And showed I had bounced a check, didnt say what check number though. I called and they would not tell me the check number!!@! After begging, I was told it was for Charter Communications. I went to their office and paid cash for what check I thought I bounced. And deposited $10.00 into the bank, deciding to get the account closed ASAP. The next day the check they said had bounced and had been returned magically cleared my account the day before. WHATTTT????? That now brought me down another $82.31, the amount of the check and 34.00 for an overdraft charge. Then my direct deposit kicked in, they took that tiny $35.00, balance now -$47.31. I scrambled to find $$ to cover that so I wouldnt go down further. The next day another 34.00 overdraft. then another... turns out there was a debit in the amount of $1.99 "floating" out there that they held onto for 7 days. They decided to try to post it as soon as my account went low. I decided to make a couple calls: 1) Child Support Services- these checks are NOT to be held unless you owe money. ok, so why did they hold the first check? Also, the State of Oregon Child Support Services uses US Bank for its checks. SAME BANK so the checks are available immediatly. Also, that check cleared on 1/08/06, TWO DAYS after I deposited it. They didnt hold the check, they held the MONEY... but where? and why? (to make sure they got their bounced check fees?) 2) Charter Communications- that check did not bounce nor was it returned. It cleared my account on the same day it was submitted, 1/12/06. Gee, thats the same day I was charged two overdrafts and a returned check charge. But yet it did not show that check clearing...Hmmmmmmmmm..... That was it. I was DONE. I called and had my DD stopped, and received an unemployment check in the mail that day. I also had a refund from the power company of the city I lived in before I moved. I decided to go in and get answers and close my account. Yes I was mad, but I know how to handle myself in situations. I told her (Sherrie) the manager, I need answers. Then asked her about all of these issues. WHY WHY WHY. She was very RUDE, smirking and telling me that SHE told me when I opened my account that it was MY responsibility to tell the teller to put a no hold on the checks. NO she didnt, YES she did.... back and forth...I tried to keep my cool, SHE was yelling. I asked about the held money...the "bounced" check, everything. She basically called me, the State of Oregon, and Charter Communications LIARS. I didnt want to argue anymore. I told her fine, I want to close my account, I have two checks to cover the charges, and one is a Government check, so PUT IT ON A NO HOLD DEPOSIT SLIP. Yes I raised my voice. She grabbed the checks and I said I still need to sign them and slid them back over and signed them, and gave them back. She looked at them and threw one at me saying, "I'm not cashing this one" WHY??? "Because of your attitude". I told her my attitude???? Im not the one with an attitude, you are. Why are you cashing the other one then? "Because I know we will get the money for that" (Government check). She went and did her thing, leaving me sitting there shaking my head and laughing. This has been the strangest encounter I have ever had at a bank. She came back, slammed down the balance of the check and my deposit slip on the desk in front of me and said "there, your account is closed,good luck opening another account somewhere". Was that a threat??? I dont know... whatever. I picked up my money and looked at her and said, "Have a very nice day... you c*nt" I know, I should not have said that, but when you push someone like I have been pushed, that is a very tiny little thing that I COULD have done. It's the little people like me who they know they can get away with stealing from. Those who dont have much to begin with, who dont have the power, nor the funding to fight back. My brother died suddenly and my father put the $80,000 life insurance in US BANK. This was June of 1991. The money was not touched and it kept going down instead of up. They kept telling me not to worry, the longer you leave it in there, the more it will grow. We had $25,000 portion we could write checks so in 2000, we got a roof on the house less than $2000 and wrote check out of that account. Later we got a storage shed for $1200. I noticed in 2001 it had a Margin Loan balance and started calling on that. They said not to worry, that was nothing, just letting us know how long the money had been in account and if we needed to make a loan we could. This went on for months and finally that Margin loan kept going up and I finally got a guy that said he could explain. He said that when we originally took out that $2000 for the roof, we should have told someone that it looked like a loan so they started charging like a charge card...I said WHAT, this was our money. Then he said when we got the shed it did it even more and that it was in our contract and nothing we could do about it. It was about -20,000 by then. I cried and said get it out of that account. He said sure and asked where to put the balance and I told him what account. WELL....we never saw one red penny. That account was closed out and gone. $1000 deposit was made the next day and when I asked where the other part was they said, that was the initial amount and the rest would follow. To this day, nobody at US BANK can tell me where that money went.C

US BANK has screwed us more than once. I am secondary on my fathers other savings I had a car loan with them. I did not agree on the amount they said I owed on my car after paying 5 yrs. They changed names 3 times while my car note was involved with First Union, Firststar and then US BANK. I told them they had it wrong and was a few days late on a payment. They said I owed $8000 still and I had 4 payments left of $3000 so that was a big difference. I had paid 5 yrs on $20,000. They took $9000 out of my fathers savings account because I was listed as secondary. This was with 1 month late and I paid in between and they never even refunded my payment. That was so unfair to do. 30 days late and my father lost $9,000. I never even got the payment I made of $500 back. They are crooks for sure. CR

Culver City, CA branch on Jefferson - I went to the culver city branch today and was very unsatisfied. I have 3 accounts there and i am closing every one of them. I went to cash 2 checks with my US bank atm card and a state issued photo id- which has never been a problem. The teller told me that she would look my account up, but it is something they "normally don't do". I take it she was doing me a favor in giving me my money, then she threw my money at me and never once said thank you or anything. If she doesn't want to work with the public then she shouldn't. US bank does not have anything that another bank doesn't have. L

I have had previous thoughts that the online banking system US Bank maintains is often times inaccurate. On several occasions, I have noticed very strange transactions appearing, and then once again disappearing on my account. On the date of January 16, 2006, I checked my US Bank Checking Account via their online banking system at www.usbank.com. I had several purchases awaiting authorization, and my "Available Balance" was a far positive number (I do not have the exact amount, as I felt no reason to record this information). I checked my account balance via the online system again today, January 18th, 2006. All of a sudden, my account balance was negative $118.66. I had been charged two overdraft fees of $34.00 a piece from transactions that apparently went through negatively on January 13th, 2006. These transactions were not authorized as of January 16th, 2005, so this all appears very interesting to me. I then received three more overdraft fees at $34.00 a piece on January 18th, 2006, as a result of the two overdrafts they posted to my account on the 17th. I tried contacting US Bank via their local customer service number (612-872-8657) at 4:58pm today, January 19th, 2006. I talked with Jerome, who assisted me on the phone for quite a while, but informed me that there was nothing he could do. He told me that their system showed that the transactions that went through on the 13th were fully authorized and went through on the 13th. He informed me that maybe the online banking system was having problems, but did not look into this matter. I then asked to speak with his supervisor, Chris Fleharty, who informed me that he would not do anything to remove the charges from my account. This call lasted a total of 29 minutes and 52 seconds. I am going to receive another two overdraft fees for transactions that will be authorized shortly, as a result of the recent five overdraft fees. Thank you for your assistance! I would like all the overdraft fees associated with this error to be fully refunded to my account as soon as possible. Currently, I have a total of $170.00 in overdraft fees associated with this error. Soon, I will be assed another $68.00 in overdrafts, a result of this error. That would make the total of overdrafts $238. I would also like any negative balance fee's that may be added to my account from this error to be fully refunded.

They screwed me over big time. What a corrupt institution and a joke of a government agency, the inept OCC, that allows this stuff to go on. Do yourself a favor and avoid a giant headache plus protect your money by staying clear of US Bank. R

The kicker is the person who bugged the sh*t of me about a refi, was a manager and he pushed Cinci heavy on us, Funny thing is he one day on a Friday I went in so they fix another screw-up on a local level that involved a teller and a wrong account posting. He told me told to check him Monday morning and he would make sure it was resloved. Monday came, he was gone and no one was speaking as to whereabouts or reasons for. Somebody put 2 and 2 together for me and confirm my suspicion, and find an attorney that will do something about it... Does anyone have any info on these names Charles (chuck) Moore, Margaret Strotman, Rhonda Schweitzer, Robert Hengee. We are talking top of the food chain. The USBank branch here is so bad that the tellers are now automatically handing out $5.00 deposits with every transaction, you don't even have to ask. We expect them to pull out of Colorado in a year or two. They have also sent out massive postcard mailings saying, in effect, "if we treated you badly in the past, we are REALLY SORRY and want your business back." No one is biting. I have been with US Bank for a long time. I have direct deposit from my employer and child support enforcement so I have stayed with the bank because I didn't want to go through the hassel of changing all my accounts. At this point I don't care anymore. I have been ripped off by this bank repeatedly in the last year ...... they contiually pull money from my account from the largest transaction to the smallest regardless of when it occured and then add 34.00 dollar fees to the point of a 15.00 dollar over draft costing me almost 300.00. The bank told me to manage my account better and when I suggested they take money as it is "debited" from my account they gave me a run around on there process. It all comes back to there was money in my account and they did the their best to take a small error of a few dollars and turn it into several hundred dollars. My account balance is never what the on-line banking shows.....they have a million excuses as to why......and again they take as much in overdraft fees as they can by taking the highest dollar amount first and adding a fee each time. Is there a class action suit going that I can be added too?? L

We have a mortgage loan with us bank. The loan became delinquent. Now we have been able to bring it up to date, but us bank tells us that we have a $15,000 charged off account in relation to this loan plus the actual mortgage of $62,000. We can get no information on what this $15,000 charge off is due to. The customer service rep is very nice and says he is checking but he has been checking for months and we still don't have an answer. We are ready to sell house and need this matter resolved. R

US BANK - THE VERY WORST Check the internet for complaints against banks, and you'll find that US Bank takes the cake. They are by far the very worst. If you decide to open an account with them, you are an IDIOT. Save yourself the trouble, stress, anger, and money -- go somewhere else. Their policies are inconsistent and UNFAIR, and their customer service is non-existent. I've sent several emails to my personal branch, where they claim that someone will be in contact "within 24 hours -- our 5 star guarantee". What a bunch of bull. I've not heard a single reply, and even when I call - nobody helps me or even listens to me. This year alone, they've taken over $2000 in BS overdraft fees. I'd post examples, but it'd be redundant - look at other people's complaints -- that's what they did to me too. They're thieves and they dont' belong in out communities!! We have the power to put them out of business -- let's do it by taking our business away or by never giving it to them in the first place. What USBank has done to a couple of senior citizens - This is the letter I wrote to the Comptroller of the Currency:

This letter is occasioned by transactions initiated on our checking account with US Bank over the past week. That is account # ********* which we have had at the bank for ten years, since opening it in the fall of 1995. This account is held jointly with my husband, our names being on the account as J*** K. or D***** B.
By my calculations, on Thanksgiving weekend, 05, we should have had nearly $500. in our account. I keep very careful track of the checks and debits coming out of our account, but on that weekend - Sunday, I believe - I called the automated line to enquire of our balance. I was shocked to be told that we had only about $78. in the account. I finally got a "live voice" on the line, and asked about the previous few transactions. A man cited a debit to "Pro- Active" as among the last couple. "Oh, no," I exclaimed. "I cancelled that."
"Okay, ma'am," he responded. "We will put a stop on that. It's back in your account." That meant, to me, that at least I had (rounding off in my head) $125. in the account. I went ahead and bought a couple of things, using my debit card. I checked my balance again, finding, to my dismay, that it was showing an overdraft of $9. - and more debits waiting to be posted against the account. Knowing that we didn't have any more money coming in until the last of the week, I borrowed $150. from our son and deposited it in the account, feeling that should more than cover those.
When my semi-retired husband, who had been off work since going into the hospital on Sept. 18th, and undergoing a bypass on Sept. 23rd had finally gone back to work, getting two small checks. The first one, for $218.67, I deposited on Friday, 12/02 at 4:07 and to my consternation, the balance showing on the back was showing only $115. I went in and talked to a banker, who patronizingly and laboriously went over our print-out, treating me like a 12-year-old and chastising me that I had not recorded 6 or so "foreign" ATM charges of $1.59 each - as though that would accoount for a nearly $500. discrepancy.
He gave me a balance of a little over $200., according to his calculations, and I went over every single entry with him, finding a number of things which, in the end, I challenged. I filled out forms for each one, challenging it. (About four $9.99 charges coming out automatically and monthly - unknown to me, and months worth of the "Pro-Active" $48. debits - which I had cancelled. I talked to a man on the automated line, who told me that he was "putting that most recent one back into our account," I told him. He seemed affronted! He haughtily informed me that no one on the their line would do that, nor had the authority to do that. There was another debit from someplace in (suburban) Indianola on Sept. 28th. "No, no," I said, "that's impossible, because my husband was flat on his back in the hospital on that date, and I wasn't far from him. Neither of us was even IN Idianola." I challenged that one, as well.
Next, my husband's Social Security check came in the mail - that same day, on Friday the 2nd, not the usual 3rd, but having had one very frustrating trip to the bank already that day, I deposited it on Saturday morning, along with a $300. check drawn on the State of Iowa, which was to buy clothing for the 3 foster children we took into our home on the 18th of November. (I'd already spent "out of pocket" for the children, and when I put the deposit of $1,100. in on Saturday morning, I thought, "thank goodness, at least we're going to be all right until that other business gets straightened out."
I took the children clothes shopping for most of the rest of the weekend, using my debit card all over town on Saturday afternoon and Sunday, spending the $300, and finally putting these 3 kids into some "nice" clothes.
On Monday, I put another small check of my husband's into the bank . . . and questioned the teller, because the balance on the back showed "abvailable balance -$124.70, and balance $1,176. She explained that since they "wait" 2 business days to post the checks (Say WHAT? The Social Security check, drawn on the U.S. Treasury and the State of Iowa check, drawn on the State of Iowa Treasury?) Have they put overdraft charges on our account for those?", I asked. She went away and came back and said, "No, I checked , and I don't see any overdraft charges." "Best NOT be," I told her tersely.
Today, I got and deposited a check from the State of Iowa, payment for the care of the 3 children for the 13 days of November, that they were in our home. That check was in the amount of $628.42. I looked at the back of the deposit receipt, and incredibly, it showed only $941.71. I marched myself reight in, to that same smug fellow, and demanded to know what was happening to our money! He got all smug and patronizing, and got another print-out, showing PILES of overdraft charges, and then, incredibly an entry which reads "CONTINUOUS OD CHARGE and an entry of $1029.19, ultimately leaving us with $949.71. Out of $2220. of deposits over the past week, they have charged as overdraft, $30.x6=$180., $35x6=$210. and most incredibly, the "theft" of $1021.10.
My only recourse appears to be to appeal to you to "reason" with U.S. Bank, as it appears that, without you, good people who are just doing our best to live our lives and keep our account "in the black" have no hope of doing so. I cannot believe what they have done is legal, even though they have shown me (again, patronizingly) that ALL of my deposit slips previous to today's show as 12/05, which was Monday.
This, then is the letter written to the Comptroller of the Currency. We have, however, never heard anything from either the C of C or from US Bank. It appears we are "stuck" with our account being pilliaged by US Bank in "overdraft" charges . . . charges which were "contrived", anyway. This is what they have done to a couple of senior citizens, and to the 3 little kids who are our foster children . . . just before Christmas. I don't know how we are even going to pay our bills, let alone give these kids a Christmas. And there are "automatic" pays slated to come out of our account, two of them (house and car payments) to US Bank, itself! JJ

US Bank FRAUD - US Bank has charged me a late fee on my car loan for the last 36 months ! and now that I am about to pay off my car they say I owe a whopping $2,243.00, $1,300 of that is late fees !!! So they say. I am suing US Bank for fraud!MD

Screwing USB Retirees - AGAIN ! This past week U.S. Bank announced it will payout, in cash, certain retirement accounts of former officers and managers in their older "unqualified plans." Why is that bad? Because it has significant and harsh income tax impact on these retirees. Instead of receiving $400 a month in pension payment, we will now receive a lump sum of perhaps 10 times that amount this December, and the IRS will take 25% to 38% all at once. The tax law permits a "Trustee to Trustee" transfer capability, specifically to avoid this taxation problem. However, Mr. Grundhofer and team are not allowing that option -- no point in making thing easy for former employees who are now retired! Just another example of the disrespect this management team has for its employees. J

Finally - After over a year of misinformation and being run around I finally got the answer to the status of a bond this lovely bank was the trustee of. Keep in mind I never asked for a dime from U.S. Bank, just information. I filed a complaint with the Securities and Exchange Commission through my United States Senator. GEEZ I CAN'T BELIEVE ALL OF US GOT SCAMMED -My husband had gotten a credit card offer in his email. I was at work that night. I came home and he said he was told he would have to cancel in 3 days. We tried to cancel as I was royally TICKED off that he would do something behind my back like this without asking me. I called them, got a rude man who spoke barely any English (I am mulitlingual) and so I had to go into HIS language. I told them I was in law and I would SUE his butt. He got his supervisor on the phone and I again told them that I DID NOT authorize ANY DEBITS to my account. She said to download a refund form from the site, which I couldn't do anything with and fax it in. This morning I went to cash a check at my bank for a friend and couldn't cash it because our account had been debited by a company (didn't state it was iCard) it was something that started with a V in it for $159.00 AFTER I had put a STOP-PAYMENT on it. How the HELL are they doing this and still no in prison????? RW

My 15 year-old daughter got a job and she got her first paycheck. It was drawn on a US BANK check so I took her there to cash it. They said she could not cash it for her because she did not have an account. So, we opened a joint account since she is only 15 years old. Well, we were almost done with opening an account when the banker said, Oh Yea I forgot to tell you, you have to open a checking account to have a savings account. So I did and we put my daughters check in the checking account. Then after opening the two accounts, we went to put money from the checking account into the savings. The banker told us that we could not have the money for five business days. THIS WAS A CHECK DRAWN ON USBANK. Well anyway I kept the accounts and I had the account 4 months. In that time the account always had $200 dollars in it and the savings had money in it too. Still, they want to hold every deposit you make that is not cash for five business days. So you cannot have access to your money. I had 3 overdrafts. One of $1.47, one of $13 and one of $2 which was an ATM fee. Each time my account was overdrawn was because US Bank would not release my funds. So, I got a $30 overdraft for a $13 check. My account had $167 in it. A $2.00 ATM fee from another bank came through the same day. They paid it and charged the overdraft fee of $30.00. I still had $167.00 in my account. US Bank would not release it. I also had a $25 check come through. I was short by $1.47 but still had the $167 in the account. Because they would not release the funds from my account MY MONEY - I PUT THE MONEY IN THE ACCT BECAUSE THEY WOULD NOT HONOR MY CHECKS FROM A CHECKING ACCOUNT THAT I OPENED AT US BANK - The expense cost me $118 in fees - from US Bank not releasing my funds of $167 that was still in the account. But wait. The same day as soon as I owed them the $118, they released my $167 and paid their fees. Isn't that something and they put the remaining $49 dollars in my account. Now that sounds like 5 Star Service. A 5 SERVICE _ _ _ _ ING....IS WHAT IT WAS. When I went to talk to them about this problem, everybody played stupid. No-one could help me. All I got was we will have a bank manager call you time after time. I think this is a legal way of fraud actually. L

US Bank SCREWED ME - I had a balance of 186 dollars yesterday when I checked my balance before going home from work. That was including the rest of the debit transitions that were still pending. I went to check my balance today and found it was $160 overdrawn!!! I added funds from my savings account and got it down to $70 in the hole and then used paypal to transfer another $200 in to my account. I checked my balance after my lunch break not even 5 hours later and they have 6 overdraft charges listed on my account with another 2 coming out tomorrow. Now US BANK is telling me I am being charged for every single transaction that is still pending!!! it comes to over $500 in over draft fees, for small things that aren't even over 50 dollars. I have 5 transactions that are tops of $6, and I am being charged $30 dollars for each!!! That there is BULLSH*T!!! I have to go until Thursday before any funds come in. By then I won't have any money left for my rent or to live for the week. I am not happy with US BANK BY ANY MEANS. They got me! Recently I wrote a physical check to my daughter’s school for tuition. I knew this check would incur an overdraft charge. Sometimes you just do what you have to do. That weekend I used my debit card (w/ pin) 6 times, for groceries, dog food, etc… The following Monday the tuition check posted. Instead of the debits from the weekend clearing first, the bank manager decided to put the physical check through first which put my account balance in the negative and gave him the opportunity to charge me $33 for each debit I transacted over the weekend. His excuse was that the debit cards were really just paperless checks and that on the weekend any debits you incur aren’t really processed, even though they are visible online and seem to have been taken directly from the available balance. This has to be criminal. I am so angry. I feel helpless and at the mercy of corporate America. So, I am going to close my account there and not bank anywhere. I’ll just work with cash and money orders. There has got to be someone out there who can get this company for stealing and misleading their customers. This weekend my mortgage check was electronically debited from my account. This again, put me into a negative status. I assumed that the bank would go ahead and pay the check. I got paid on Monday and could cover it. This time they decided to return it. In which I was also charged $31. For an electronic debit!!! In a recent article in the Kansas City Star about this issue, the Regional Manager, Robert Benson, of US Bank was quoted as saying that the bank doesn’t want it’s customers to be embarrassed if they are on a date or something and don’t have sufficient funds, so they like to be able to help their customers out and let the debit go through. So they don’t want to embarrass you at Taco Bell or McDonalds, but when something really important comes through, like the mortgage, they return it! That affects my credit rating. I just think this is so wrong and something needs to be done to change these ridiculous practices. Being charged $262 for being in the negative by $200 is not right. On a Thursday night, after business hours, I used my U.S. Bank check card to pay bills electronically. I thought I had enough money in my account to cover the charges but as it turned out I was about $80 dollars short. But, this should not have mattered since I made a $700 deposit to my account the very next day. None of the "check card authorizations" actually posted to my account until the following Monday at which time I had more than enough money to cover all of the charges. For your information, U.S. Bank, by their own admission, does not release ANY funds to the merchants UNTIL the charges POST to your account! What happened is that on the Friday after I had made the charges U.S. Bank charged me overdraft fees on 6 items that posted to my account that day. They said they had to charge overdraft fees because they were "holding" the money I had used for my check card charges and thus my account had become overdrawn. You see, U.S. Bank has this wonderful thing called a "ledger balance" and then they also have what they call an "available balance" which basically means they like to confuse a consumer with two different balances. So, although U.S Bank does not release the actual funds until the transaction posts to your account. they WILL charge you overdraft fees for the money they are "holding"!!!!! Well, currently U.S Bank has charged almost $1000 in FEES because they also charge a negative balance fee of $7 per day!!! All of these fees were charged even though NO actual overdraft ever occurred on my account!!! BEWARE!!!!! CT

Been there, done that! They also will take multiple checks that come in and charge the highest to the lowest so that if you are overdrawn they can charge more overdraft charges. BTW dont look for the USbank ATM to tell you you're over your balance. They will gladly give you $300 more than what you have and sock you with overdraft fees and negative balance fees. A Veteran friend of ours found some CD's that his wife had saved for him. The CD's were made in his name and his wife's name and only could be cashed by her in the case of his death and vice versa. When the wife died, he took the CD's to the bank and US Bank said the account was closed on 4-11-92 and there wasn't any money in the CD. No Activity. The Veteran and wife did not withdraw the $ from the CD's. He has gone to a lawyer, went to the State and just went to arbitration and the verdict was The Statute of Limitations have run out - so there is no proof of who withdrew the $ -- approximate $30,000 plus face value. The bank didn't show any withdrawal slips, cancelled checks or anything. They are insuinating that the veteran forgot he took out the $. He didn't even know about the CD's until his wife died. They hadn't gotten any bank statements or anything. Nothing. Veteran is 80 years old, WWII Paratrooper. It was written that his wife would have to have his death certificate to cash the CD's. His name was first and then POD Pay on Death and then her name. This veteran needs help. Any ideas? They said records are in Iron Mountain. JG

I've had a US Bank Visa card since March of 1999. I have excellent credit, never having missed a payment, been late, or even paid just the minimum payment. I always pay double or triple the minimum payment. I do this not only with my US Bank Visa, but also with auto loans, a line of credit, and a Master Card account I have with other lenders. In June of 2005, US Bank raised the interest rate on my Visa from 11.99% to 21.99%! When I asked why, I was told that they ran a credit report on me and that my credit score was below their threshold for acceptable risk! Give me a break! The limit on that Visa is $13,000, and at the time it had a balance of $10,071. I obtained my own credit score through Experian, which showed a FICO score of 720. But get this, on my credit report it clearly shows US Bank faithfully reporting my monthly Visa payments and balance since March 1999. Then suddenly, after raising my interest rate, they stopped reporting the monthly balance. It's September 10, 2005 and the last month they reported was June 2005. By not reporting payments and balances, my credit score remains as it was in June. Since June, I've paid the balance down to $6075.00, an amount that is below 50% of the credit available. Credit scores are based in part, on how much available credit you are using. By intentionally keeping your credit score where it was when they jacked the interest rate, they can continue charging exorbitant interest rates. I'm curious how many others have experienced the same thing? I'm also curious to know if this is legal, and if not, how a class action can be initiated. Quite frankly, their business practices are disgusting, if not criminal. I intend to have this account paid off and closed by January 2006. From that date forward, I will have absolutely nothing to do with US Bank ever again. A

I have an experience with a vehicle loan and my cousin had a checking account with them. I was disgusted by their harrassment to me. I was 2 weeks late on a payment, one morning I received 18 phone calls even though every time I picked up the phone!!! This is not a joke. Then I went into a branch bank to deposit money for my cousin. I spelled her married name wrong 3 times but they still let me deposit the money after they told me her address and I confirmed it. THEY THEN GAVE ME A RECEIPT OF THE TRANSACTION WITH HER ACCOUNT NUMBER ON IT, THE WHOLE NUMBER. So lets recap - these idiots gave me her address and account number and all I did was give them her name which I misspelled 3 times. Oh but here is the kicker, I gave the loan company my account number to make ONE payment. Within one week they took 3, $300 payments. This caused my account to over draft with $749 nsf fee's. Needless to say I told my bank to black list them from my account. C

I have a pending lawsuit against US Bank and another mortgage company. They forced me to file bankruptcy three times when I should not have had to file just to save my home. When they realized their accounting errors and lost mortgage payments, they sold my loan to EMC Mortgage Corp. without crediting my accouct for the lost payments nor correcting any of the errors to my account. When I refinanced about a year ago, the mortgage company contacted US Bank for a payoff. It took about a month to get a payoff and that occurred only after threatening legal action and several calls and trips to the bank. Anyone even considering a USBank mortgage should have their head examined! Creeps - US Bank does suck. They have racked me up with 213.00 in overdraft fees in 2 days. The first overdraft fee I take full responsibility for. I promptly made a deposit of 200.00 to cover it and any outstanding purchases. The deposit gave me a positive 44.00 balance until later that day they posted 2 more late charges of 30.00. I discussed it with the _ _ _ _ _ _'s which did no good. I deposited another 200.00 and now they have another overdraft fee of 34.00. I just want to report them to someone!!!!!!!!!!! MR

I, too, have a horror story about US Bank. It's concerning the ID theft of my son's (who is a minor) social security number. I am still in the middle of this situation with court dates in August, so I'm not sure how much I can say at this point. I'm grateful to find your website as I have been feeling very alone in this situation. US Bank has been VERY uncooperative and in the begining, treated me like I was the one trying to defraud the bank and to date, the two employees who really screwed things up in the beginning have not apologized, they still have their jobs and won't look me in the eye. I've had unexplained withdrawls from my checking account as well as my son's ID theft situation and all I hear is "prove it". UNFAIR PRACTICES BY USBANK - US Bank cheats people every way that they can think of. One way is when they pull checks each day from your account they pull the largest to the smallest check in order to charge you more overdraft fees. Most banks will pull the smallest to the largest. You probably would be charged one fee if they did it the fair way but the way they do it you will be charged many fees. Also most banks have a limit on the amount of overdraft fees they will charge you each day. That limit may amount to about 3 overdrafts charges. US Bank will charge you for each check overdrawn no matter how many there are. So you will you be charged ridiculous amounts of money. It can be hundreds of dollars! This is not a bank you want to do business with. They are heartless to their customers. RW

US BANK Bond Dis-service -Are you ready for this? Have registered municipal bond. Bond recalled. US Bank was final trustee. First contact with US bank, they said send the CUSIP # on bond and they would locate money. Sent copy of bond, US bank said the validity of bond was in question. When explained to them this was ridiculous. They said copy was not readable. Not about to send them original bond so they can put it in shedder. J

I need an attorney! I was fired shortly after reporting a manager who threw a pen at me during a leadership meeting. I was physically and mentally abused by my manager at US Bank, then fired. I am a 52 year old woman who was employed at US Bank as manager of Training and Communications. In February of 2005, during a leadership meeting, the US Bank Commercial Loan Services VP threw a pen at me and another female manager and told us to "Shut up!." I later found out that he had physically abused another female manager by punching her in the shoulder. I had been intimidated and harassed by this man for over one year, but finally mustered up the courage to report his behavior to his manager and HR. Within two months, with the help of one of his proteges, he had me fired. On the day I was fired I passed out outside the main entrance, experienced severe chest pains and was taken to the hospital. US Bank has prevented me from retrieving my personal belongings and refused to pay me my earned vacation. NN

US Bank froze my account without giving me any notice or warning. I was not able to access my account so was unable to get food, gas, etc. MF

BE SURE and check your account if you have direct deposit. I can't count the number of times that I checked the account at like 6 a.m. and see my direct deposit before a draft. Then, later in the day, the draft miraculously came the day before, was before my direct deposit and I was hit with overdrafts. Somehow, with the appropriate creative accounting, they are able to make the most money for US Bank and screw the customers who make them. H

Well obviously my situation isn't nearly as serious as many of the others that I have read. I originally opened my accounts at the local branch when it was still Mercantile Bank before U.S. Bank came onto the scene. Mercantile bank then sold out or was absorbed by First Star. That is when my life started to become interesting. I commonly used the drive up window for my transactions. They started asking me each time if I was the only name on my bank account. As usual I would say yes and move on. Finally one day one of the clerks advised me that my information was incorrect, and that there was another individual on my account. I requested their name which they provided. I advised them that they would have to remove her name from my account. They advised me they couldn't remove her name until she came in and signed the proper forms. I told them that this was impossible due to the fact that I didn't even know who she was. I went into the bank and resolved the situation, or so I thought. I later learned they had lied and left her on my account. Thank goodness one of the managers I knew at a branch office resolved this issue. I suppose that is just a pre-fix to my current problem which is overdraft charges. I do bank online and check my balances regularly. When you bank online you have two categories, Available balance and Account balance. It was Saturday afternoon and the bank was closed for the day. My available balance showed a negative balance of - $14.00 and a positive balance of $60.00 in my account balance. Alright, I screwed up, my fault. First thing Monday morning I deposited funds in my account to cover the negative balance. When I went to bed that night, my available balance showed a positive balance. Much to my early waking surprise, I awoke not to an over draft charge, but 3. At $29.00 apiece, that left me at $87.00 additional dollars in the hole. Believing in getting to the bottom of things I went to the bank and sorted out the charges. They were kind enough to dump 2 of the charges, and I agreed to pay 1. They told me when I left that that particular account had $35.00 in it. We discussed the 2 pending charges of $2.66 and $5.00 that were pending. But with the $35.00 in the account as I was told, they were more than satisfactorly covered. The next morning I awoke to an extra 2 service charges of $29.00 apiece. I once again called the bank and asked them about the 2 additional charges. First they denied that we even discussed the $2.66 and the $5.00 pending credit card/debit card purchases. Now I have 3 accounts at the bank. 1 was opened at a facility about 20 miles from here when I worked there. The other 2 accounts had been opened at the facility closest to my home. I was told since I opened the initial account at the other branch that my local branch could not help me and I would have to contact the other. This is not the first time I have dealt with cascading charges, or that they have claimed to fix them only to add more charges to my account after thay haven't. On my most recent encounter, my available balance had showed that the debits had already been deducted from my usable funds. Thus the monies had been removed. When they list their overdraft charges, they do not show them as deductions but as over drafts. So I either still had $60.00 in the bank to cover all of my checks, or I had one over draft for $14.00. How this bank can claim both I will never know. Anyway I am going to make a feeble attempt to talk to the bank president tomorrow. But I suspect that will go nowhere. JE

Complaint- Every time I call them their policies seem to change. Their phone reps are the least competent, helpful, or empathetic of any bank I have dealt with. Doing fraud prevention for a living I have to call a number of banks every day to verify card holder information, in effect protecting -their- customers against fraud, and they are one of the worst banks I have to deal with, I avoid them whenever possible. I've even had them change account information for customers during confrence calls giving nothing more than the debit card number and home address! On my personal account they have been charging me double for every NSF I incur lately, and even the supervisors refuse to help... unless it's after hours, when it's too late to do anything. They are terrible, I've never dealt with a bank, personally or professionally, as bad as US Bank. I strongly encourage everyone to find a local credit union to sign up with. They may not have the convenience of having branches in every neighborhood of the USA, but they are competent, personable, and fair. Insensitive customer service rep - My mother passed away in Feb. 2002. When I took my father to the local branch in Kirkwood, MO. to close out her accounts and transfer funds to another bank the customer service rep? made the following statement and I quote her "Why do you want to transfer the money to Commerce. She is dead and doesn't care where the money is." Fortunately my father is profoundly deaf and did not hear the comment. The second major problem occured later in 2002 after my father passed away. He had a CD there that they insisted was not in his revocable living trust and would have to go thru probate even though I had been receiving statements from them listing it among his CDs in his revocable living trust. After numerous phone calls and paying our family attorney additional fees to settlle the dispute in our favor I was able to close out all accounts at US Bank. I dealt with other banks, mutual funds, insurance companies, Edward Jones, A.G. Edwards, and my father's former employer without any problems. U.S. Bank employees were insensitive, obnoxious, and very difficult to deal with. Never will I have any dealings with them. DrQ

Another USBank Con Job - This is minor but I have always been told that for ATM deposits, $100 is credited immediately and the rest of the funds are available the next day pending verification. On May 2, I made a deposit of a paycheck for $268.38 at 7:56 PM. According to my receipt, the $100 being immediately available, my available balance was $110.64. Although I have a printed receipt from US Bank showing this information, they are now saying that the first $100 was not credited until the next day, and the remaining balance of $168.38 until the DAY AFTER THAT! This makes no sense whatsoever, since I could have gone to the bank in person on the morning of May 3 and gotten credit for the entire amount immediately. Due to this fraudulent information posted on their receipts which does not reflect what they are in fact doing with their postings, my account became, according to their records, $34.36 overdrawn, and they charged me an additional $34.00 overdraft fee on it. I have been out of work for over a year - this paycheck, from a temporarary agency, is the first paycheck I have received this year. Needless to say, I need every penny of my $268.38. I have spent over an hour with US Bank on the phone trying to get them to reverse the $34.00 charge, to no avail, even although I have a printed receipt from them showing the money in my account. I will be closing this account TODAY regardless of how this is resolved. NB

Do Not Bank at US Bank - I was employed with us bank and it is the most un organized horrible company that I have ever worked for. I never had enough training on exactly how to do my job and I came to us bank with 10 years of banking experience. I worked for the branch in Republic, Missouri and just found out that I was supposed to be getting flood letters for each residential loan and that I was horribly out of compliance. I am sure that if customers knew that loan files were left unlocked in the lobby each night that they would no longer do business with us bank. I was also not paid for my fifth and sixth week of short term disability and was not told until I was off work more than four weeks that I would only be paid for four weeks. us bank treats its employees (in my opinion) terribly. In my branch we had several employees leave the first year I was there. I also felt that they discriminated, and that even the managers didnt know what they were doing. I am glad that I moved on, but I plan on telling everyone I know how us bank operates. W

$5 check cashing fee - I received a check from a friend for splitting room during computer conference. When I go to cash his check at HIS bank, US Bank, they wanted to charge me $5 because I was not a member of their bank. The check said "US Bank" on it with a local address (sometimes banks won't cash checks from them, if they are out of state) but they don't care. Hell even Wall$Mart only charges $3 to cash a check! 7 years ago I started a checking account with usbank in spokane,wash. and today it hit me, I've been paying $10.00 a monthly fee, some of my co-workers told me it was free checking. TO ALL MY FELLOW AMERICANS WHO ARE INSURED! I have just gone through a ten-year court battle with the 6th largest bank in the US. This court case is the basis for a serious problem in the US that has not been address by any news agency or Newspaper. I am working on a feature story with a journalist from a local TV station regarding this case, and a major newspaper journalist. This will be a great way to reach the hometown customers of the defendant however; I would like to spread the word as far as possible to help the thousands who cannot speak for themselves. Also, to help the future thousands who are going to be in the same situation if we do not expose this corporate loophole, which destroys the lives of the most vulnerable people in our country, the disabled. You see many news articles on TV telling the story of the poor insurance companies getting abused by the insured clients who commit fraud. These criminals collect disability payments when they are not disabled. In fact, this number of clients is less than 2% of the disabled who are able to apply for disability. The other 98% are not criminals and really are disabled. Many of them are patients of a well know doctor who treats severely disabled people who have been brain injured in an auto accident, fallen off a ladder, slipped on the ice or injured at work. When you go into this hospital, the first thing you notice is the creatively painted ceiling. The ceilings are painted with designs and pictures because most of the patients cannot sit up.They lay on a bed 24 hours a day, some able to talk, some not. The day before all of these new patients were living the lives many of us lead. Getting up for work, laughing, talking with friends and family. These patients were not aware, tomorrow they would never be able to sit up, never be able to talk, sing, laugh, walk or remember what they did yesterday. The biggest thing they did not know was their employer is also their insurer. Most large corporations in this country are self-insured. They carry the employees of their companies under an insurance plan that they manage and fund. In many of these situations they make the decisions on who should get disability pay and who should not. 90% of disabled patients are denied disability at one point. Many of them will fight for years before they will get a dime from their insurance company, who is really their employer. The majority of doctors who deal with totally disabled patients will tell you that most of their patients will have to fight for their payments even if they are laying in a bed, unable to comprehend anything. Corporations who insure their employees are not bound by the same laws insurance companies are. You can pay your employer (insurer) disability premiums for 5 years, become totally disabled and never get a dime from the insurance policy you took out. You pay for this disability policy to protect you and your family if the worst case should happen. Your employer (insurer) can deny you benefits for 10 years with no reason and they cannot be penalized under the ERISA law. This law allows special privileges for corporations who insure their employees. One of these privileges is that they cannot be held accountable for any damage to you, your family or your future by not paying you the premiums you are entitled to. If your employer wrongfully denies your payments when you are totally disabled, the most they have to pay you is your lost wages, maybe interest and maybe legal fees. This is the case even if 11 doctors say you are totally disabled and cannot ever work again! You could wake up tomorrow, get in a serious auto accident on your way to work, never be able to work again and the insurance policy you took you to save your home, savings account, retirement, Childs education or just money to eat and pay your bills would be gone.You would not get another dime from your employer (insurer) and you could not do one thing except hire a lawyer, spend 10 years in court with ridiculous attempts to delay, delay and delay. After you lost everything, you would win your suit, win an appeal, win another appeal and then you would have to hire a US Marshall to try and get you the money.This sounds impossible? It happens hundreds of times every day. Check with human resources and see if your insurance premiums are going to a reputable insurance company or if your employer is insuring you. If your employer insures you, check out who makes the decisions on whether you will get paid or not. Are they paying the people on disability or do your fellow employees have to go to court to get their payments? Did they have to take a reduced settlement to get money to pay their mortgage or buy food? Ask your fellow employee,currently on disability, what their experiences have been. I was employed by one of the largest banks in the country and this happened to me. This has happened to many in my corporation. If it can happen to me it can happen to you.

Why haven't we heard about this? Because the majority of the people who are abused by this law, and the corporations who abuse it, are not able to or don't want to talk about it. They are not able to talk or endure the trauma of dealing with this abuse. The majority makes a deal with the corporate abusers and takes far less than they should get. They take far less because they have to feed their families, pay rent after they have lost their home. Pay medical bills because their auto insurer did not pay them. Please read the following excerpt from the court order. This is just a part of the 70-page report from the judge.Please help me stop this abuse. You will know someone who will be affected by this law. This law encourages abuse of those not able to defend themselves. I will do anything in my power to help you or a loved on who is suffering this abuse. As of today March 28.2005, US Bank filed an intent to appeal to the federal appeals court again. No reason was given for the appeal but the bank has offered to put 3.8 million dollars up for bond on the 2.25 million dollar judgment the court has entered against them. Here’s my problem with US Bank: For the past 3 years, a US Bank branch president = my former boyfriend has been stalking me online and using company (First Bank) servers to do it. I cancelled my business and personal US Bank accounts to prevent my ex from accessing my information, and I was assured by my local bank president and a corporate security person that they would take appropriate action to keep this troll from using US Bank /First Bank servers to harass and spy on me. However, THEY NEVER EVEN SPOKE TO HIM ON THE PHONE. They never told him to stop it, they never investigated (and I have logs of my web site showing that this wanker has spent hours of company time, every single day for the past 4 months) and he is still doing it. This is in direct violation of US Bank’s written company policy which is clearly stated on their corporate web site (www.usbank.com). To add insult to injury, the so-called corporate security buffoon I spoke to not only didn’t contact my ex nor act on my complaint, but also spoke to me in a condescending, how-dare-you-besmirch-a-USBank-manager tone. I advise everyone to seek another bank and other financial services. ME

Update: I believe that US Bank severely abuses customers. On May 31, 2002, a US Bank branch in Nashville, Tennessee issued a $61,000 check from our US Bank account to a non-owner and unauthorized party. After reporting the unauthorized withdrawal to US Bank, US Bank reacted by refusing service. When we attempted to hold US Bank accountable, US Bank then lied to the OCC, filed false statements in court and denied that we were customers. During court proceedings, US Bank refused and/or failed to produce our banking records from the account. After two and a half years of denials and false statements, US Bank finally admitted negligence. Our deposits were not safe in US Bank. I no longer believe that any customer's money is safe in US Bank. Since it happened to us, it could happen to anyone.

I run the www trustmatter com website. I concur that US Bank Trust entirely lacks conscience. Based upon our experience, US Bank has evinced NO ethics and NO sense of accountability. Within the next month, I will be posting a transcript from a hearing that we had today regarding a US Bank Trust. Under interrogation, the trustee acknowledged making many mistakes and not taking care of business. The negligence was blatantly obvious. The guy left the entire Trust invested at 0.78% (.0078) in a money market fund (a proprietary fund of US Bank, no less) for months on end. It was blatant negligence. And that 0.78% (.0078) was before undisclosed investment fees and before an annual fee of 0.75%, a base fee and attorney fees. It was simply unconscionable. No one could live on what US Bank did with the Trust. There were numerous other problems, as well. Including the fraudulent disbursement of over 60,000 when the trustee did not have that cash amount available in the Trust at the time and could not account for why he dispersed that specific amount. The disbursement left the Trust at a loss for the year because the guy had not even made enough to cover his own fees. By all indications, that transaction was backdated as a favor -- as part of a quid-pro-quo deal. There was a more substantial quid-pro-quo deal, as well, as is documented on the website. It was completely unethical. Moreover, the US Bank trustee inexplicably traded in and out of investments in less than a week's time, which also resulted in losses. We believe this was done to generate commissions on those purchases (of proprietary funds) for the trustee. US Bank does not disclose those commissions to customers -- rather, they hide them in the fine print of prospectuses. And yet even as we had a very experienced, expert CPA testify to all of these problems, it would appear that US Bank bought out the judge -- a rural Iowa judge that has automatically approved this US Bank's trustees accounting statements time and time again. And we're not the only family who has had problems with this particular US Bank Trustee. It's symptomatic of a much larger problem with this trustee and the local judicial system. After the trustee admitted to making numerous mistakes and after the CPA testified to all of the problems, the judge disregarded all of that testimony and approved the accounting on the spot, without any deliberation time whatsoever. Our attorney and the accountant were absolutely astounded. It was blatantly obvious that the judge had made up his mind prior to the hearing. We had an abundance of irrefutable evidence and statistics against the bank. Thus, we are going to post those statistics AND the transcript, to let people know the extent to which US Bank plays dirty with the court system. Listening to what this trustee acknowledged, there's no way that a sane person would have approved this trustee's accounting. And yet this local judge turned a blind eye to all the evidence. It's absolutely appalling.

Anyone who has a Trust with US Bank should be on the lookout for US Bank's use of the First American Funds. As some may know, those funds are proprietary funds, from which US Bank profits in numerous ways. However, US Bank did not disclose the use of those funds to the beneficiaries in this case for nearly two years, and then even after that, never disclosed that they were in-house funds and that US Bank profited from the use of those funds. This was all kept secret and hidden, and further kept secret in very convoluted, misleading accounting statements. You have to read the fine print of their prospectuses to figure out what is going on with those FA funds -- and they certainly never send you their prospectus. It's an undercover business by which US Bank exploits the financial legacies of elderly folks for its own benefit while not openly disclosing how the bank is profiting. There is a reason they hide the details in the fine print and back pages of prospectuses. In the future, the website will be telling the story of US Bank's use of proprietary funds to further line its own pockets at the expense of Trust clients, particularly the elderly.
We were absolutely shocked when the local judge approved the accounting yesterday. For one, there was an article in the Omaha World Herald newspaper on Sunday (March 13th), in which US Bank was found negligent in a different Trust case -- and in that case (in Nebraska, not Iowa) they were found negligent by a jury for "only" making 5.8% per year. My grandfather's Trust did much, much worse than 5.8%, and yet the judge in our case did not find US Bank negligent. We would have been satifisfied if the Trust had made 5.8%. But this just goes to show how corrupt the local system is compared to this other case in Nebraska where US Bank was found to be negligent. Just this morning, I posted more details about the Judge involved in the case to my website. This same local judge recently suspended the 30 year sentence of an accountant who had embezzled 100,000's of dollars from several local organizations. The guy had been sentenced to 30 years, and this judge intervened and let him out in only three months. I kid you not. The community was in an uproar over it. So, this just underscores the corruption going on in this particular County in Iowa. It makes no sense because the trustee came off as a total idiot on the witness stand yesterday. So, I will be posting the transcript as soon as we are able to get it -- it may take a month or so to get it. Yes, US Bank lies over and over. And they are very bad at lying, too. When the trustee was confronted about commissions he received, he claimed that he had never seen the prospectuses for the First American Funds (where the commissions of 1.25% are spelled out). He said that he had never seen any of the prospectuses at all. Then what the heck was he doing investing money in the funds if he had never read their prospectuses? And the Uniform Trust Code clearly states that banks need to provide those prospectuses annually when there are proprietary funds involved. He was obviously lying -- or else incompetent. Keep in mind, the guy is also a VP of the local US Bank. And yet he claimed he had never seen nor read the prospectuses. This will all be in the transcript when it is posted on our website. There are details in the transcript that we are sure that US Bank (and the US Bank trustee, in particular) does not want released.
You have no comprehension of the depths to which US Bank will go to manipulate the legal system. Nor do you have any comprehension of the FACT that US Bank will charge beneficiaries for US Bank's own attorney fees. That is a fact in the case. The beneficiaries are charged for US Bank's attorney. Sound unbelievable? Well, it's a FACT . In this case, US Bank's attorney ran up a blind tab for two years without notifying the beneficiaries of what he was doing. And then he charged the Trust for two years worth of undisclosed services which were nearly exclusively him defending and abedding US Bank and dismissing the beneficiary's concerns. Moreover, after two years, he also presented bills WITHOUT any hourly itemizations nor dates so that there was no way for the Court to evaluate the charges. US Bank charges the beneficiaries for US Bank's own attorneys. That is a FACT. THe system is screwed-up and corrupt. And this is a WARNING to others as to what to expect. These are the problems that others will face as customers of this bank, as well. This is a WARNING that you will be paying for US Bank's own attorneys.
The corruption is in the local legal/judicial system. I have been documenting it for over three years now. This US Bank trustee has received a free ride time and time again by this judge. Accounting reports are automatically approved, without any scrutiny. The trustee doesn't even bother to show up for the hearings because he expects automatic approval. Indeed, this same local judge recently suspended the 30-year sentence of an accountant who had embezzled 100,000's of dollars. He let the guy out of jail after only 3 months. This is the way the system works in this particular county/area. I can assure you that it's not about a re-election of a judge. It's purely about ol' boys politics and local corruption. I am sure those at U.S. Bank who are familiar with this case know exactly what I am referring to and the parties I am referencing. However, U.S. Bank is no less implicated since they chose to partake in the system. They apparently think that as long as their trustee is let off the hook, they don't have to address the problem nor remedy their negligence. As long as their trustee is making money for the bank, who cares about ethics and accountability? US Bank claims on the Trust section of their website that they will "transfer wealth to the next generation or your favorite charity, in the most tax-efficient manner possible, tomorrow." However, their actions with this Trust will have cost my family *at least* 100,000 dollars in unnecessary taxes. So, this is clearly a lie.
U.S. Bank clearly violated several provisions of the Trust Code. U.S. Bank *knows* that they violated those provisions. U.S. Bank *know* that they breached fiduciary duty in several different ways regarding this Trust. These breaches of fiduciary duty are as clear as day. They would be blatantly obvious to any accountant. And they surely are blatantly obvious to U.S. Bank. In fact, this trustee violated U.S. Bank's own alleged policies for Trusts. We had a simular problem with the OCC. US Bank lied left and right in response to our OCC complaint filed last year -- US Bank made it seem as if the Court had chosen US Bank (not true! the beneficiaries chose US Bank) and that the matter was a civil case. We immediately responded to all of the lies in a letter and by phone, and then interestingly enough, after not hearing from the OCC from October through March, suddenly on March 26th, a letter just appeared from the OCC, with the excuse that it was a "civil" case and they (the OCC) had no jurisdiction over the Trust -- even though it is a full-fledged *account* with an *account number* at US Bank. Nobody can tell us that they do not have inside communication with US Bank. As you already know, the OCC is funded by the banks and caters to the banks. What a fraudulent "government" agency! TM
