Nipmuc Family Notes:
Scipio & Esther Jaha
By Thomas L. Doughton
Scipio & Esther [probably Pegan] Jaha were married sometime prior to 1759 and would settle in Shrewsbury, Massachusetts
In 1763, Scipio & Esther Jaha, and two daughters, Alice & Molly or Mary Jaha were "warned out" of Shrewsbury by the town selectmen. Warning out that the town assumed no responsibility for your support. By being "warning out" Scipio & Esther Jaha were not official residents of Shrewsbury. (MS: Worcester County Records: Court of Inferior Pleas, the Justice of the Peace records: Volume 3: 1758-1767: Page 223: "The Selectmen of the town of Shrewsbury in said County are allowed to enter their caution against Scipio Jahar and Esther his wife & Alice her daughter & Molly alias Mary Jahar now residing in said and whom the selectmen refuse to admit inhabitants they having been duly wanred to depart out of said town as by warrant under the hands & seals of said selectmen dated at 22nd day April last & constables return thereon on file appears" from Justice of the Peace Session of February 1763)
In 1765, Scipio Jaha received a deed for a quarter ace parcel with a dwelling house in Shrewsbury from Benjamin Maynard of Shrewsbury. (MS: Worcester Registry of Deeds: Volume 55:155: instrument conveying title from Benjamin Maynard to Scipio Jahar of a quarter acre parcel with house for some 33 pounds, Oct. 9, 1765, for an instrument signed Nov. 2, 1762)
In 1770, Scipio Jaha sold this same property, for which he'd paid 33 pounds in 1765, to Samuel Pike for 20 pounds. (MS: Worcester Registry of Deeds; Volume 62: 564: deed from Scipio Jarha to Samuel Pike, for some 20 pounds, dated March 10, 1770)
Scipio Jaha and his family would be tenants on Pegan Band Indian land in Dudley at the time of his death in 1786: at that time he owned 100 bushels of oats, 11 sheep, haystacks, corn & beans growing in the ground, stored potatoes, an old axe, a shovel, 2 old sickles, 3 barrels of cider, 1 draft chain, 2 dry calves, wearing apparel, wool, a yoke & a note for 8 pence. (MS: Worcester Probate Registry: Series A: Case 32910: Inventory of Estate: Volume 20, 411)
However, Scipio Jaha was insolvent in 1786: and his family was unable to adminster his estate because they were Pegan Band Nipmucs under the supervision of guardians. (MS: Worcester Probate Registry: Series A: Case 32910: note dated at Dudley, Aug. 16, 1786, by Edward Davis. guardian of the Pegan Band: "next of kin cannot administer for they are of the Dudley tribe of Indians as his wife is a squaw and all the family under guardians and considered minors at law...he was a negro and not under guardians and occupied as a tenant by order of the guardians...")
