DOJ Declines to Appeal Veteran's Victory in Transgender Discrimination Case

A Statement from NCLR Legal Director Shannon Minter

DATELINE San Francisco, CA —The U.S. Department of Justice (DOJ) has declined to appeal a federal court ruling awarding transgender veteran Diane Schroer the maximum compensation for the discrimination she suffered by being refused a job with the Library of Congress because of her transgender status.

Yesterday, June 30, was the deadline for the government to seek an appeal in Schroer v. Library of Congress, in which Ms. Schroer has been ably represented by the American Civil Liberties Union (ACLU). The Bush Administration had defended this case vigorously, arguing that transgender Americans are not protected by any existing federal laws, but the district court rejected that argument.

A statement from Shannon Minter, Legal Director of the National Center for Lesbian Rights:

The DOJ’s decision not to appeal this case is correct, and we applaud it.

Discrimination against transgender people is sex discrimination, and the discrimination levied against Ms. Schroer by the Library of Congress was blatant and indefensible.

The DOJ’s decision not to appeal the verdict is consistent with the Obama administration’s campaign promises to protect transgender workers against discrimination and the administration’s recent order taking steps to bar gender identity discrimination in federal employment.

Ms. Schroer, an Army Special Forces veteran with 25 years service, has our deepest appreciation for honorably and steadfastly pursuing her rights for several years to this successful conclusion which marks a significant victory for transgender workers across the country.

Gay invitees ‘eager’ for White House reception

Pride month event to recognize work of LGBT Americans

President Obama has invited a several key players in the LGBT community for a White House reception Monday to celebrate Pride month.

Shin Inouye, a White House spokesperson, said in a statement the event "is a chance for the White House to recognize the accomplishments of LGBT Americans."

"Invited guests include families, volunteers and activists, and community leaders," he said. "This event was long planned as a way to applaud these individuals during Pride month."

The event comes as many activists are urging the president to take greater action on LGBT issues including the repeal of the Defense of Marriage Act and "Don't Ask, Don't Tell."

When questioned about the event Friday during a briefing, Press Secretary Robert Gibbs said the president doesn't plan to make any substantive announcements at the reception regarding DOMA or "Don't Ask, Don't Tell." A number of invitees told the Blade they are nonetheless interested in attending and hope to speak with Obama.

Joe Solmonese, president of the Human Rights Campaign, said in a statement that he's attending the event because he believes the objectives of the LGBT community "require us to be present and to use every opportunity for dialogue and discussion even when we strongly disagree on the level of progress that's been made."

"I believe the president will deliver an address on the state of LGBT equality and it's important to hear those remarks first-hand and have the opportunity to talk directly to the president and members of his administration," he said. Solmonese said he would continue to the press Obama and Congress to deliver on "basic and overdue protections," such as passing hate crimes legislation and the Employment Non-Discrimination Act, as well repealing DOMA and "Don't Ask, Don't Tell."

"I continue to respect President Obama and believe we can achieve our goals for equality in partnership with this Administration," Solmonese said. Robert Raben, a gay consultant and a U.S. assistant attorney general for legislative affairs under President Clinton, also is among the invitees. Raben said it was "remarkable" for Obama to hold the event and noted a distinct contrast between the sitting president and former President George W. Bush.

"Going will help me get over lingering anger I harbor toward the last president, who for eight years showed singular success as an anti-gay leader," he said. "President Obama promises to be a real leader on LGBT equality and I am eager to do whatever I can to do the work to fulfill that promise." Another invitee, Servicemembers United Executive Director Alex Nicholson, said he plans to attend because those who have been affected by "Don't Ask, Don't Tell" should be "at the head of the table in dealing with this issue in the political arena."

"If I am afforded any time with the president, I plan on using the opportunity to drive home the point that a highly educated, well trained Army human intelligence collector who speaks five languages, including Arabic, is ready and willing to return to military service on the day the ban is lifted," he said, "and that nothing could be better for our national security and defense efforts than for this to happen sooner rather than later."

Robyn Ochs, a bisexual activist with BiNet USA, a nonprofit for bisexual Americans, said she plans on attending to represent bisexual people, which she called an "identity group that is often overlooked both within our beautiful LGBTQ community as well as in mainstream society."

"I want the president to understand our impatience," she said. "While we are waiting for inequalities to be corrected, we remain second-class citizens, and people are harmed every day."

She decried, among other issues, how 265 service members have been discharged under "Don't Ask, Don't Tell," and how gay bi-national couples are often kept apart under current immigration law.

"We need concrete action, and we need it now," Ochs said. "This is the best presidential administration I've ever lived under, and my expectations are high."

Other confirmed invitees include:

• Rea Carey, executive director of the National Gay & Lesbian Task Force;

• Aubrey Sarvis, executive director of the Servicemembers Legal Defense Network;

• Jim Hormel, a former U.S. ambassador to Holland and the first openly gay U.S. ambassador;

• Fred Hochberg, who's gay and chair of the U.S. Export-Import Bank;

• Stampp Corbin, a San Diego-based gay activist who supported Obama during the presidential campaign;

• and Lt. Col. Victor Fehrenbach, an Air Force pilot who was discharged under "Don't Ask, Don't Tell."

Gay U.S. Reps. Barney Frank (D-Mass.) and Jared Polis (D-Colo.) were not slated to attend the event because they have commitments out of town, spokespersons said.

Jerilyn Goodman, a spokesperson for Rep. Tammy Baldwin (D-Wis.), the only out lesbian in Congress, said the congresswoman has yet not decided whether she'll be available to attend.

Peg and I were invited guests at a historic event: June 29, 2009 marked the first time a United States President ever hosted a reception for LGBT people at the White House. I was there representing BiNet USA and the Bisexual Resource Center (BRC).

Yesterday’s reception was an important symbolic moment. While symbols are not the same as action, they have their own value and power. The President and the First Lady warmly welcomed into the White House a group of people that has historically been excluded.

Remember: It was our community's creativity, hard work, and persistence that built the road that brought us to the White House.

When Peg introduced me to the Obamas as her wife, and they looked into our eyes and shook our hands, I was profoundly moved. “We will get there,”

President Obama assured me. I’m not certain whether his “there” is exactly the same as my “there,” but I believe him.

Looking around the room at elected officials, government workers, seniors, lesbians, gay men, trans activists, activists of color, cultural workers, youth activists – of course, many in the room were wearing multiple hats – I was struck by the size and by the wonderful diversity of our movement. For every familiar face in the room, there were so many more movers and shakers who were not present.

I hope that President Obama understands the sense of urgency that we in the LGBT community are feeling right now. It is very hard to wait to be equal. Every day that passes, actual people are harmed. Qualified and competent soldiers such as Dan Choi are discharged. LGBT families suffer because we lack full legal recognition. People in bi-national couples who love one another are denied the opportunity to be together. I have several friends in this situation. I have friends who have had to emigrate to the United Kingdom, to South Africa, and to Canada to be together. I have other friends who are separated from the one they love because neither their country nor ours recognizes their relationship.

And every day we pay higher taxes than heterosexual couples and receive fewer government benefits. I am married in Massachusetts since the first day it was legal, and since that time I have paid more than $12,000 in extra federal income taxes than I would have had I been married to a man instead of to a woman. You see, I am taxed on the difference in value between an individual and family plan (“imputed income”) because DOMA prohibits the federal government from recognizing our marriage as valid. Married mixed-sex couples are currently not taxed on their family health plans. Imagine if we could have put this money toward our retirement!

Our level of frustration is so high at this time because, for the first time in our lifetimes, there is a possibility of real, substantive change.

We understand that the President has a great deal on his plate, but he is the best hope that we have ever had and it is hard to wait. We have been waiting for a very long time.

Art of Surviving Art Show: Coming this Summer - Stay Tuned for more information

The Art of Surviving is a project bridging the perspectives and work of survivors of sexual violence, educators, activists, and scholars through the lensof a dynamic exhibit of artwork and poetry created by survivors of sexual violence across Virginia. It asks the question: "What is the art of surviving?" in the wake of the experience of sexual violence. The exhibit seeks to raise awareness about the prevalence and scope of sexual violence, its impact on individuals, families, and communities, and the process of moving from victim of sexual violence to survivor. The Art of Surviving recognizes that survivors are experts on their own experience and that among activists, educators, and scholars, many of us are also survivors. The art and poetry provides survivors, many of whom have felt silenced, a voice with which to discuss sexual victimization and healing and to speak out about the realities of sexual violence and survivorship.

We like Robin not only because she has a really cool name (ROBIN, get it?), but also because she is totally upfront about being a bisexual woman as she sings songs of feeling and sophistication. If Robin Renee were to start a religion all her own, it might well hold Groupie Consciousness as its central tenet. She chases after the God/dess within with a reverence and fervor not unlike her passion for the music that moves her most- acts as disparate as Elvis Costello, Krishna Das, James Taylor, Gary Wilson, and Devo. Those in the know are realizing that Ren�e is worthy of just as much hot pursuit. Oh, and that religion? There'd also be lots of yoga, a strong belief in cartoon physics, a little sexiness, and zero dogma.

Such is the musical and magical world of Robin Ren�e. Her accessible tunes with a spiritual twist have forged her personal genre--Mantra-Pop! The seeds of her diverse influences can be uncovered therein, as well as a longtime focus on Eastern and eclectic mysticism, the mystery that cuts to the core of this powerful singer and wordsmith. At a live show today you might catch a solo acoustic set, a collaboration, or pure kirtan- a form of Hindu devotional chanting in Sanskrit, with which she finds deep resonance.

Live Devotion - brand new and soon to be released is Ren�e's first recording dedicated wholly to sacred chant. Borne of one inspired recording session in October 2006, the seven long tracks evoke peace, passion, and the presence of Universal Love. With the sexy, rock feel of "Jai Ma" to the traditional "Sita Ram" to the fun, multi-part "Om Shanti Krishna," Live Devotion is a fresh take on an ancient tradition.

Ren�e's previous offering, All Six Senses, is the real-life chronicle of one caught in the act of cosmic transformation. Themes of love, seeking, and celebration emerge through a medium of edgy rock, accomplished singer/songwriter lyricism, pop hooks, and the sonic impact of chant. All Six Senses was produced by Scott Mathews, who has worked with artists as fabulous as George Harrison, Ringo Starr, Elvis Costello, Patti LaBelle and many more. Two of its tracks, "First Sight" and "Thursday Morning Afterglow" won Honorable Mentions in the 11th International Billboard Songwriting Contest. All Six Senses follows In Progress, Ren�e's full-length CD debut (2000). It follows In Progress, which was applauded in much alternative press across the U.S.

She has often credited the sight of David Bowie in a dress with opening her eyes to transformation and expression. It was no doubt an inspiration, but Renee's real drive comes from within. She has battled through the wearying grip of depression, has been enveloped in the bliss of spiritual ecstasy, and lives to tell the tales. She is not afraid to listen to what the voices in her head tell her: Live for your truth, keep it real, and make music that matters.

Publishers' Note: We also follow up on the life and times of Zoe Lewis. A long long time ago we were at a local club, and on stage came the small woman with an English accent and her band. What we heard next was just amazing... in fact, some of us were just awestruck with her talents. Keep in mind some of us are not "womyn's music fans", but this womans' musical abilities are just something and her range of styles is also remarkable. BIO:

Openly lesbian folk-pop artist Julie Clark has released her second full-length CD of all-original materials on January 13, 2009. In addition to songs ranging from serious to sexy, her second disc features the funky, soulful gay rights anthem "Courage of Our Convictions" which is destined to help mobilize the GLBT equality movement.

Maintaining a busy national touring schedule, Clark has blazed a name for herself among GLBT venues coast-to-coast, performing regularly in the gay mecca of Provincetown, Massachusetts, at popular gatherings such as The Michigan Womyn's Music Festival, The National Women's Music Festival, Capital Pride in Washington, DC, and as a returning favorite on the GLBT cruise circuit. She was an OutMusic nominee for Female Debut CD of the Year and has also been interviewed on the NPR syndicated radio program "This Way Out."

Clark�s personal story is one of radical transformation. It�s hard to imagine now, but for much of her life Clark weighed 200 pounds more than she does today. Few artists have undergone such a profound physical and emotional change. Her lifelong struggle with obesity, and her ultimate success, has forever shaped her music and view of the world.

NPR has called Clark "an edgy newcomer", Portfolio Weekly (Norfolk, VA) describes her songs as "funky pop burners that would make Shakira blush and Madonna smile."

Participate needed in Research Opportunity: From Samantha Tornello, for Dr. Charlotte J. Patterson University of Virginia for Professor of Psychology
Are you a gay/bisexual dad? Would you be willing to answer some confidential questions about your life and about your family? The purpose of this study is to examine the many ways families headed by gay fathers have been created, explore how families function, and learn about the relationship between partners.

The study consists of an online survey and will take approximately 25- 35 minutes of your time. To qualify for the study you have to identify as male, a father, and gay, bisexual or homosexual and have at least one child of any age; this child can be biological, adopted, foster, step, or other child. You do not need to be the child's legal parent to participate. This study has been approved by the University of Virginia IRB #2008-0407-00, and I am working with Dr. Charlotte J. Patterson who is a Professor of Psychology at the University of Virginia.

Buddy and his wife Edna went to the state fair every year, and every year Buddy would say, “Edna, I'd like to ride in that helicopter!”

Edna always replied, “I know, Buddy, but that helicopter ride is fifty bucks, and fifty bucks is fifty bucks.”

One year Buddy and Edna went to the fair, and Buddy said, “Edna, I'm 85 years old. If I don't ride that helicopter, I might never get another chance!”

To this, Edna replied as usual, “Buddy, that helicopter ride is fifty bucks, and fifty bucks is fifty bucks.”

The pilot overheard the couple and said, “Folks, I'll make you a deal. I'll take the both of you for a ride. If you can stay quiet for the entire ride and don't say a word, I won’t charge you a penny. But, if you say one word, it’s fifty dollars for the two-fer.” Buddy and Edna agreed, and up they went.

The pilot did all kinds of fancy maneuvers, but not a word was uttered. He throttled through daredevil tricks over and over again, but still not a word. When they landed, the pilot told Buddy, “By golly, I did everything I could to get you to yell out, but you didn't. I'm really impressed!”

Buddy replied, 'Well, to tell you the truth, I almost said something when Edna fell out, but you know how it goes … fifty bucks is fifty bucks!”
