| Civil Rights, To be or not to be? Part II What do you think? I filed three separate complaints of judicial misconduct against three separate judges. (1) The first complaint of misconduct was against Federal Judge Ricardo Hinojosa from the Southern District of Texas, McAllen Division. I complained of his tampering with court transcripts and tape recordings. Judge Hinojosa removed crucial phrases from these records. His actions are a federal felony and violations toward my civil rights .. my rights to due process, fairness and justice. (2) The second complaint was against now former Magistrate Judge Peter Orwensby from the same district as Judge Hinojosa whom denied me my rights under Federal Rule of Civil Procedure 50 and 56 in regards to proper discovery. Wherein he refused to provide me access to documentation that would have proven my case and to which I had full rights to. (3) The third complaint was against Magistrate Dorina Ramos of the same district whom refused to allow me to speak during my initial hearings and allowed the defendant to violate discovery procedures as outlined within the Federal Rules of Civil Procedure violating my rights to due process, fairness and justice. Procedure calls for complaints to be routed to the Chief Judge of the Circuit. In my case, it is the Fifth Circuit and the person responsible for addressing the complaints of misconduct was and is Chief Judge Carolyn Dineen King. Judge King, whom had the highest number of complaints of misconduct filed within her Circuit in comparison to all the other circuits in the year 2000, simply dismissed my complaints without any proper investigation being conducted. Note: I contacted a party at the state level whom handles complaints of judicial misconduct against state judges. He stated that a similar complaint filed at the state level would have generated an investigation as they are fully aware that a person complaining most likely does not have neither the monies nor legal expertise in conducting an investigation into the matters complained about. Judge King also bars me from filing any future complaints of misconduct against any judge in her Circuit. I wrote to the Supreme Court asking if this was the method Judge King wished to employ in reducing her high numbers. So what her order does, besides violate my rights, is to allow any judge to do anything they please against me. And as they would do after her order was made. The injustices continued and I could not complain. Note: I've written to the Supreme Court quite often. They never respond. But I keep writing. I then sued Chief Judge King for stripping me of certain Civil Rights. District Judge Filemon Vela of the Southern District of Texas, Brownsville Division, whom the case was assigned to, dismissed my suit without allowing it due process. Just simply dismissed it. He also barred me from filing any civil suit. I submitted my appeal. Judge Vela refused to stamp file receive it. Or that is, to docket my appeal. I called the United States Court of Appeals and spoke with Amanda Sutton. She tells me that they cannot do anything about it. She states that the appeal is what gives the Court of Appeals jurisdiction over my case. So if Judge Vela refuses to file my appeal then they cannot proceed. I tape recorded one of Judge Vela's clerks telling me that he has strict orders from Judge Vela ordering him not to file my appeal. I mailed copies of the tape to the United States Supreme Court. They never respond. Several months later, I get a letter from J.B. Rogers of the Attorney Advisor's Office from the Fifth Circuit Court of Appeals in New Orleans, Louisiana. I call her asking for an explanation as to what it is exactly that she is requesting of me in the letter. She states, that she needs me to serve Judge Vela with my appeal and send her the proof of service. I stated to her that I could send the tape recordings wherein the judge refuses to file my appeal. She states she doesn't need them as they already are aware of his actions. I asked why she needed this from me. She stated that the Appeals Court was going to order Judge Vela to file my appeal. She stated if I had anything else to add. I said, "Yes" that, though I did want this, it would also further cause me injuries from the judges in this district, as I didn't think Judge Vela would be pleased. As said. Magistrate Judge Recio, serving under Judge Vela, dismissed a retaliation lawsuit I had standing before him without stating any reasons as to his decision. He also refused to acknowledge any evidence presented by me that proved my case and gained me a right to a jury trial. These are simply a few of the injustices I have faced and suffered in the Southern District of Texas, McAllen and Brownsville Divisions. D. de la Cruz |
