Most "Tenants' Rights" questions can be answered at our "Legal Resources" WebPage, which has a comprehensive layout of the entire Florida Statute for Residential Landlord-Tenant Law, in a very user-friendly "Point-Click-Go" format.  This "Tenants' Rights" WebPage is designed to summarize and explain selected statute provisions which are especially important or which are most often disputed or which may seem confusing to the lay person.
 
      In most cases this will not be an elaborate explanation of Tenants' Rights.  In one or a few sentences we will state the "Right" and then, where applicable, we will cite the Florida Tenancy Statute which protects that Right.   Keep in mind that our "Legal Resources" WebPage Section contains the entire Florida Chapter on Residential Landlord-Tenant Law. This "Tenants' Rights" Section is not intended to be comprehensive or all-inclusive.  There may be other "Tenants' Rights" not mentioned here.  This is simply intended to be a general, easy-to-read straightforward summary of most Tenant Rights covering many common situations.  We offer it because The Royal Parc Apartments - Miles Properties Inc. organization is bent on misrepresenting, deceiving and trampling on Tenants' Rights here at Royal Parc.  A well-educated Tenant can defend himself or herself against such a landlord.
 


 
  Tenants have a Right to the "Quiet and Peaceful Use and Enjoyment" of the Premises which they are paying for.  It is called getting "The Benefit of the Bargain."  It is deemed to be the most fundamental benefit which all tenants have bargained for in their agreement with the landlord.  When a landlord violates this Right the Tenant's 'benefit' has been damaged, i.e., diminished.  That Tenant has gotten less than what was bargained ... less than what s\he paid for.  This means it is actionable under the law.  The Tenant can litigate to recover his\her losses at the hands of the landlord (F.S. 83.55 "Right of action for damages").
 
  Tenants have a Right to be safe and secure in their person and possessions, without landlord interference with Tenant's personal privacy or the security of his\her possessions.  A landlord may not "Tortiously Interfere" with the Tenant's Right to be secure in their person and property.  Basically the term "Tortious" (Tort) means 'unlawful damage done to a person and\or a person's property.  Like many Tenant Rights, this one and the one above are mainly derived from the same general civil laws that apply to everyone.  They are not unique to the Landlord-Tenant statutes.  This means it is actionable under the law.  The Tenant can litigate to recover his\her losses at the hands of the landlord.  See the "Tenant Options" Section for a discussion of the numerous ways a Tenant can seek to recover his\her damages at the hands of the landlord (F.S. 83.55 "Right of action for damages").
 
  A Tenant has a Right to read, review, contemplate and ponder a Lease "out of the presence of the landlord" before signing it.  And a Tenant has a Right to have his\her attorney read, review, contemplate and ponder a Lease "out of the presence of the landlord" before Tenant signs it.  The Royal Parc Apartments - Miles Properties Inc. management tries to mislead and deceive Tenants into believing they MUST come to THEIR office to read, review and sign the lease there in THEIR presence.  This is their "Bad Faith' calculated design to inflict the Tenant with undue pressure to sign the lease, while in Bad Faith, trying to deny that the Tenant has the Right to take the lease home with them and the Right to take the lease to an attorney for review, legal evaluation and assessment.
 
  A Tenant has a Right to reject lease provisions s\he believes are onerous, invasive, unlawful or imprudent.  Contrary to what Royal Parc Apartments - Miles Properties Inc. tells you, "Leases are negotiable."  And the Tenant would be well-advised to remember this, because this landlord will turn around and argue, if necessary, that the Tenant read the lease ... reviewed its terms ... and voluntarily agreed to those terms.  In our "Tenant Empowerment" Section we discuss how a "Tenant Association" like ours can improve your bargaining power when negotiating a lease or lease renewal.  Also See the "Tenant Options" Section for a discussion of the numerous ways a Tenant can negotiate a lease or lease renewal (strategies).
 
  For example, a swimming pool or air-conditioning may well be 'material benefits' which the Tenant anchors his\her decision on.  Often the landlord claims that the pool exists at its sole discretion.  That may be true.  But when the landlord closes that pool or refuses to repair an air-conditioner, that landlord has inflicted damages on the Tenant for which the Tenant may seek recovery.  The Tenant has been robbed of vital, crucial, pivotal benefits (F.S. 83.55 "Right of action for damages").  The Tenant MAY even have a legal basis to leave the complex on the grounds the landlord has breached the material terms of the lease.  It is different, yet very similar to, the "bait & switch" scheme.  A critical, pivotal benefit is dangled in front of a prospective buyer as an inducement to sign a contract.  Then after the contract is signed, the seller informs the buyer that the pivotal benefit that was offered is no longer available.
 
due course' i.e., without having to ask or beg for it.  Tenant has a Right to have a copy of the fully-signed lease sent to his\her residence or mailing address without having to go through a gauntlet to get it ... like the standard malevolent 'Bad Faith' landlord policy position ... "come to the rental office to get it."  Royal Parc Apartments - Miles Properties Inc. simply gives Tenants a grand-mall relentless run-around, until the Tenant gives up.  This landlord knows that every time they run a tenant through a gauntlet, most Tenants won't bother because they simply do not have time in their busy lives to play their "Gauntlet Games."  Royal Parc Apartments - Miles Properties Inc. retaliates against Tenants who assert these Rights.  Such Tenants are labeled as 'Trouble Makers.'
 
  Tenants have a Right to reasonable 'advance' notice and a reasonable limitation on the terms and conditions and circumstance under which a landlord is entitled to enter Tenant's apartment (F.S. 83.53 "Landlord's access to dwelling unit").  The Royal Parc Apartments - Miles Properties Inc. lease misrepresents the law and deceives the Tenant into believing that the landlord may enter any time it deems reasonable, 7\24, with no advance notice being required whatsoever, and for any reason whatsoever, according to its lease provision which it has Tenants sign.  Those wayward provisions are a nullity.  (See "Tenants' Rights" Section and "Legal Resources" Section for more specifics on the Florida law which specifically limits landlords right of access).
 
.  Royal Parc Tenants are NOT getting that.  Royal Parc Tenants are being routinely sandbagged by false representations and insinuations calculated to deceive and to take unfair advantage of legally unsophisticated, vulnerable Tenants.
 
  Their lease provisions and their past conduct conclusively illustrate their malicious, arrogant, impudent, militant position that they have the right to do anything they please, with no notice whatsoever.  By their reckoning, they can change the parking rules, suddenly making a Tenant's 'legal' parking space "illegal" (against the rules) and THEN they can tow that Tenant's vehicles away at his\her expense, without any notice to the tenant whatsoever.  Read the lease!  That is precisely what is says.  And that is precisely what Royal Parc Apartments - Miles Properties Inc. has repeatedly done ... and recently done.  Basic Common Sense tells most people that if the landlord does NOT adequately 'notice' a tenant, i.e., if they do not adequately and reasonably apprise a tenant of the conduct which is being prohibited, then the tenant has no way to comport his\her conduct to comply with the rules.  The law has always deemed such practices to be fundamentally unfair, unlawful and unconstitutional.  Rules must be reasonably and adequately promulgated in advance, in a manner reasonably calculated to reach the person subject to the rule.  But a malignant, malicious Royal Parc Apartments - Miles Properties Inc. 'attitude' apparently occludes their ability to exercise ordinary Common Sense."
 
Royal Parc Apartments - Miles Properties Inc. retaliatory conduct in this regard is patently unlawful and will come back to haunt them.

.  A Tenant has the legal Right to assert, defend, protect and invoke his\her Rights without interference from the landlord ... without threats from the landlord and without landlord retaliation (F.S. 83.64 "Retaliatory conduct").  One (1) day after one of our members informed President Daniel J. Miles of their intention to help organize a Royal Parc Tenant's Association, Royal Parc Apartments - Miles Properties Inc., by way of President Daniel J. Miles, sent that Tenant an eviction notice, citing fraudulent claims as to the lease provisions ... fraudulent claims as to the facts ... fraudulent claims as to their tenancy status ... fraudulent claims as to their rent payment status and fraudulent claims as to the Florida Law governing such Landlord-Tenant disputes.  This is an extremely malicious, vindictive, authoritarian landlord with a malevolent, trigger-happy bad attitude, who doesn't hesitate to retaliate, regardless of the law prohibiting it.  Apparently, Royal Parc Apartments - Miles Properties Inc. is exceptionally confident it can sandbag a court into believing its actions are not retaliatory in nature.  Royal Parc Apartments - Miles Properties Inc. retaliatory conduct in this regard is patently unlawful and will come back to haunt them.
 
 
  Often it is true that if the Tenant signed onto the Lease provision, then s\he is legally bound by it.  Royal Parc Apartments - Miles Properties Inc. confidently knew that most Tenants would not know about the numerous VERY IMPORTANT EXCEPTIONS to that general rule.  We rightly characterize these kinds of landlord tactics as conduct which is malevolent, anti-tenant and as conduct which is engaged in with "Bad Faith" landlord intentions to defraud and deceive innocent vulnerable Tenants.
 
  Royal Parc Apartments - Miles Properties Inc. and their slick, savvy lawyers full-well know they are making fraudulent representations to the Tenants when they make this claim.  We rightly characterize these kinds of landlord tactics as conduct which is malevolent, anti-tenant and as conduct which is engaged in with "Bad Faith" landlord intentions to defraud and deceive innocent vulnerable Tenants.
