Gilmer County Warranty Deed
STATE OF GEORGIA, GILMER COUNTY
Whereas in obedience to a WRIT OF FIERI FACIAS issued out of the Superior Court of the County of Gilmer at the suit of Milton Davis against William H. Banks, and after being duly and publicly advertised agreeably to law, Samuel Jones, former sheriff of the county aforesaid, did lately seize the lot of land hereinafter described as the property of the said William H. Banks. And after being duly and publicly advertised agreeably to law did on the fifth day of October Eighteen hundred and forty four at the place of public sales in said county of Gilmer expose the same at public outcry, when Ananias Land, being the highest bidder the same was knocked off to him at the price or sum of Eight Dollars.
Now this INDENTURE made the fourteenth day of April in the year of our Lord one thousand eight hundred and forty six, and in the Seventy first year of the Independence of the United States of America, between the said Jehu Thomas, present sheriff as aforesaid, of the one part and the said Ananias Land of the other part.
Witnesseth that the said Jehu Thomas, present sheriff as aforesaid, for and in consideration of the sum of Eight Dollars to him in hand paid by the said Ananias Land at and before the sealing and delivering of these presents, the receipt whereof is hereby acknowledged, hath granted and bargained and sold and by these presents doth grant, bargain and sell (so far as the office of sheriff authorizes him) unto the said Ananias Land, his heirs and assigns, all that tract or lot of land situate, lying and being in the Seventh District of the Second Section of originally Cherokee (when surveyed) now Gilmer County, known and distinguished in the plan of said district by the number Six, containing one hundred and sixty acres more or less, together, withal and singular the rights, members and appurtenances thereof unto the said lot of land being, belonging or in anywise appertaining, and also all the estate right, property, claim and demand of the said William H. Banks, his heirs and assigns, in and to the said lot of land in Law Equity or otherwise, whatsoever, of, in, as, to the same.
To have and to hold the said lot of land and premises and every part thereof, unto the said Ananias Land, his heirs and assigns, to their only proper use, benefit and behoof of the said Ananias Land, his heirs and assigns forever in fee simple, in as full and ample a manner as the said William H. Banks or his heirs and assigns did or might have held and enjoyed the same had it not been seized and sold under the execution as aforesaid.
In witness whereof the said Jehu Thomas, present sheriff, hath hereinto set his hand and affixed his seal the day and year first above written.
