Public-Private Partnership - Polish
Institutional Framework and Practice
Public-private partnership in Poland is regulated by the law of
28 of July 2005 supplemented by three Decrees issued in June 2006,

Author has been involved in the legal and administrational PPP framework
creation in Poland since 2003 and also currently is advising The
Ministry of Economy on improvements and amendments to the existing
law. Public Private
Partnership is relatively new way of procuring Services of General
Economic Interest in Poland. The Polish
PPP law has been passed by the Polish parliament and formally
it does open the way for the implementation of Public Private Partnership
undertakings in the country. The current work of Polish administration
focuses on simplifying the legal framework and required by the law
analysis of the planned undertakings.
Direct involvement in the Polish PPP legislative process and track
record in project management both in the UK, Russian Federation
and Poland as well as experience with European Commission project
work allows for starting up new business initiatives in public services
sector on the basis of various legal, organizational and financial
solutions.
Author is involved in the process of standardization of PPP procurement
documents, co-operates with The Association of Polish Banks in creation
of PFI based concept of communal housing, takes part in numerous
initiatives for the benefit of regional government in the water
and sewage, construction, transport and individual projects implementation.
Publications in the national specialist publication, speaking
at conferences and lecturing completes Author’s involvement in

Practical project work beginning with a proper project scope definition
through its complete implementation is especially of interest.
Business growth area that is rapidly gaining momentum in Poland
can be broadly described as concessions PFI and Public Private
Partnership, that is not necessarily based on the PPP law alone.
For the last five years political and economic adjustment to the
new forms of public procurement has been rather slow in Poland,
however, the need for its rapid acceleration became recently obvious
to all involved in the Polish economy.
Author supports liberal changes in the Polish economy being an
independent professional with no political allegiance and basing
his work on objectively assessed optimal outcome of the project
process.
