Levee Contractor was attacked without warning

Special to the Gazette

Texarkana, July 30- The crime for which the Negro Andrew Avery was lynched at Garland City tonight was one of the most brutal ever committed in Miller County. It was not discovered until late yesterday, when Will Woods, a levee contractor on Red River, was found at a lonely place in the woods, apparently in a dying condition.
He said that the Negro, Avery, came to his camp Friday and said he wanted to buy a pair of mules, which had been offered for sale. The Negro requested Woods to go with him to a Negro justice of the peace to have the bill of sale drawn up because of the lateness of the day, the deal was put off until Saturday morning. Early Saturday morning Woods and the Negro started for the justice's house and that was the last heard of him until he was found by a searching party in a mudhole, where he had remained for 36 hours. He was conscious, but very weak from loss of blood and exposure. He said that Avery attacked him without warning, shooting him twice and beating him over the head with a the revolver. Wood says he feigned unconciousness and that after watching him for a while, Avery said; "I'm going to go home and get my shotgun and come back and finish him good. A little later he returned and could not locate Wood, Who had suceeded in dragging himself about 100 yards from where the attack took place.
Three or four times during Saturday Wood heard voices passing near him, but was afraid to call to them. About o'clock Sunday afternoon a searching party found and rescued him from his fearful surroundings. He was brought here and placed In a sanitarium An examination showed he had been shot through both lungs. through one hip and was badly beaten over the head . While his condition is concidered critical, the attending physitians say he has a fighting chance to live, Unless pneumonia should develop or other complications set in.
Avery was captured by Sheriff Walter Oden at Shepherd, 16 miles north of Garland City yesterday, The officers started to take the pr1soner to Hempsted County Jail for safekeeping. But was intercepted en route by a party 0f men in automobiles who, at the point of several guns, took the prisoner from him.
